Inspired by the globality of justice concerns in the 21st century, Global Civil Society 2011 focuses on how civil society actors around the world are framing, contesting and promoting ideas about justice, as well as their strategies to tackle the myriad injustices people face. It identifies an important shift in the globalisation of concerns about justice – citizens may claim benefits from the nation state, but increasingly groups interacting globally are collectivizing a sense of injustice. In this way global civil society has created and expanded new spaces to reinstall justice as inspiration and arbiter of laws. Combining activist and academic accounts of contemporary struggles, this yearbook provides critical insight into how civil society is remaking justice in a global arena, beyond the confines of the nation state.
Last year, Stiftung Mercator staged a round-table discussion on the topic of “Cultural Diplomacy, China and the Roles of Foundations”. Following on from the event, a special publication has now appeared which picks up on and addresses in greater detail the topics and results of the round-table discussions.
As well as discussing the various definitions of the terms “soft power” and “cultural diplomacy”, the publication raises the question of what foundations can do in concrete terms to build trust between China and the West and to foster mutual understanding – both being important prerequisites for bridging what are in some cases widely divided political, economic and cultural interests that are indispensable if misunderstandings are to be avoided and conflicts resolved constructively. The publication contains texts contributed by Joseph S. Nye, Eberhard Sandschneider, Zhang Junhua, Wang Yiwei, Orville Schelland other authors.
A Versatile American Institution: The Changing Ideals and Realities of Philanthropic Foundations

America’s grantmaking foundations have grown rapidly over the course of recent decades, even in the face of financial and economic crises. Foundations have a great deal of freedom, enjoy widespread legitimacy, and wield considerable influence. In this book, David Hammack and Helmut Anheier follow up their edited volume, American Foundations, with a comprehensive historical account of what American foundations have done with that independence and power.
While philanthropic foundations play important roles in other parts of the world, the U.S. sector stands out as exceptional. Nowhere else are they so numerous, prominent, or autonomous. Heritage, memory and identity are closely connected keywords of our time, each endowed with considerable rhetorical power. The annual Global Civil Society Yearbooks provide an indispensable guide to global civil society or civic participation and action around the world. The 2009 Yearbook explores the framings, strategies and impacts of a range of actors on poverty and its alleviation. We review the initial predictions and claims regarding economic and monetary union (EMU) in Europe against the evidence of its first ten years of existence. We argue that pessimistic views on the creation of EMU have proved to be wrong. Yet EMU's success is rather puzzling, since it is based on a peculiar institutional structure not thought to lead to success. EMU has generated redistributive effects and may have increased business-cycle synchronization. Those effects have not translated into the expected decrease of legitimacy or a widespread democratic deficit of EMU. At the institutional level, EMU has coped well with an asymmetric framework, largely decoupling EMU from political union. There have been neither major spill-over effects pushing for further political integration nor conflict and disintegration. The main question for the future is whether this institutional structure will stay the same in the aftermath of the global financial crisis.
Scholarship of multi-level governance has developed into one of the most innovative themes of research in political science and public policy. Foundations play an essential part in the philanthropic activity that defines so much of American life. No other nation provides its foundations with so much autonomy and freedom of action as does the United States. The term governance has been used in many contexts and meanings. This paper assesses three logics of control widely associated with governance, namely multi-level governance, the regulatory state and performance management. It questions to what extent these logics are present, are reinforcing or are mutually self-destructive in their effects. This paper explores the field of meat inspection as a critical aspect of the Europeanized food safety regime and concentrates on the cases of Denmark and Germany. The paper concludes that the three logics of control's effects are interactive and that, far from being mutually reinforcing, the various logics are mutually self-destructive and destabilizing.

Politikberatungsforschung

Die Verfasser stellen den state of the art im Bereich der Politikberatungsforschung dar. Nach einer Einführung in das Themengebiet und einer Skizze der konzeptionellen und theoretischen Zugänge werden die inhaltliche Beratung (policy advice) und die Beratung, die den politischen Prozess betrifft (political consulting), skizziert. Für beide Spielarten der Politikberatung werden anhand eines beispielhaften Bereichs zentrale Akteure und Handlungsfelder identifiziert und mittels klassischer und aktueller Forschungsarbeiten sowie anderer Schlüsseltexte skizziert. Hinsichtlich des policy advice werden die Beratungsstrukturen der Exekutiven auf Bundes- und Länderebene sowie ausgewählte externe Beratungseinrichtungen berücksichtigt, für das political consulting die zunehmenden Angebote an kommerzieller Kommunikationsberatung ausgewählt. Ein Resümee skizziert auf dieser Basis die Gegenwart und Zukunft der Politikberatungsforschung anhand von Forschungskontroversen, Forschungs- und Wissenslücken sowie Forschungsdesideraten.
Welfare State Formation in the Enlarged European Union: Patterns of Reform in Postcommunist States

Eastern Enlargement of the European Union challenged the design of European Welfare states. Many authors discuss the impact of East European social security systems on their West European counterparts and fear a “race to the bottom”. This paper addresses welfare state developments in the eight post-socialist new member states which completed the accession process in 2004, Estonia, Latvia, Lithuania, Poland, the Czech Republic, Slovakia, Hungary, and Slovenia (EU-8). We focus on institutional patterns and performance as well as on the impact of internal and external actors of welfare state formation. How do the EU-8 diverge from West European welfare states and how do they fit into the typology of welfare state regimes?
Dass der Sozialstaat in seiner gegenwärtigen Form ein Auslaufmodell ist, darüber besteht mittlerweile weitgehend Konsens. Über die Alternativen wird noch gestritten. Zu den wohl provokantesten Alternativen gehört das Modell der Teilhabegesellschaft: Jeder junge Bürger soll mit 18 Jahren als Startkapital eine steuerfinanzierte Sozialerbschaft von 60 000 Euro erhalten. So soll ihr oder ihm die Chance eröffnet werden, seines eigenen Glückes Schmied zu sein. Die Finanzierung erfolgt aus der Besteuerung von Vermögen und Erbschaften. Die Autoren haben das in den USA entwickelte Modell auf die deutschen Verhältnisse übertragen und durchgerechnet. In einem Anhang nehmen gesellschaftspolitische Vordenker aus Politik und Wissenschaft zu dem Vorschlag Stellung: Warnfried Dettling (CDU), Thomas Meyer (SPD), Ralf Fücks (Bündnis 90/Die Grünen), Katja Kipping (PDS), Jens Beckert (MPI Köln), Gert Wagner (DIW), Hildegard Nickel (Humboldt-Universität) und Wolfgang Schröder (IG Metall).
This article studies comparatively the property restitution policies of Eastern and Western Balkan countries, focusing mostly on internal and external constraints to a permanent solution. The role of the European Court of Human Rights is analyzed in depth, as well as the subtle shift of policy of the EU institutions from the earlier Eastern Balkan accession to the Western Balkans one. While the situation of property restitution in South-Eastern Europe provides clear evidence that Europeanization helps transformation, particularly if the EU openly assumes the role of a transformation agent, it also highlights the limits of its power.
While many histories of the Balkans have been published, some very good and others poor, there is as yet no history of institutions in the Balkans. This is what the contributors to Ottomans into European offer the reader: a history of the most salient political institutions of the region: bureaucracies, judiciaries, democratic elections, free media, local and central government - and their frequently strained relations with traditional institutions. They also examine the selection, evolution, and performance of institutions in the post-Ottoman Balkans, and try to account for variations throughout the region. In writing this institutional history of the Balkans the contributors set themselves two key questions: did the post-Ottoman wave of Europeanization and Western-type institution building fail in the Balkans, and does this explain the region's continuing political fragility? And if this is the case, are there underlying structural determinants explaining that failure which might manifest themselves again in present attempts to re-integrate the region, from Turkey to Albania?
How does regime type affect the poor? Are certain types of regimes better at translating economic growth into consumption for the world's least privileged citizens? We propose an alternative measure of transfers to the poor that is nearly universally available and innately captures distribution: average daily calorie consumption. In sharp contrast to the consumption of material goods or the accumulation of wealth for which humans have shown no upper bound on their ability to achieve, biological limits make it impossible for a small number of individuals to consume most of a nation's calories. Democracies and hybrid regimes—which combine elements of autocracy and democracy—are better at translating economic growth into total calorie consumption than autocracies and perform strikingly similarly in this regard; democracies outperform both hybrid regimes and autocracies, however, in converting growth into higher quality calories from animal sources.
This book investigates the effects of electoral systems on the relative legislative and, hence, regulatory influence of competing interests in society. Building on Ronald Rogowski and Mark Andreas Kayser’s extension of the classic Stigler-Peltzman model of regulation, the authors demonstrate that majoritarian electoral arrangements should empower consumers relative to producers. Employing real price levels as a proxy for consumer power, the book rigorously establishes this proposition over time, within the OECD, and across a large sample of developing countries. Majoritarian electoral arrangements depress real prices by approximately ten percent, all else equal. The authors carefully construct and test their argument and broaden it to consider the overall welfare effects of electoral system design and the incentives of actors in the choice of electoral institutions.
Das europäische Mehrebenensystem wird weithin durch eine spezifische Arbeitsteilung charakterisiert, wonach die europäische Ebene stark im Bereich Pareto-optimierender und eher unpolitischer Marktregulierung sei, den Mitgliedstaaten dagegen die klassischen Staatsaufgaben wie Sicherheit, Besteuerung oder Bildung vorbehalten blieben, die tief in individuelle Belange eingreifen. Der Beitrag zeigt anhand der inneren Sicherheit und der Steuerpolitik, dass sich die EU im Gegensatz zu diesem Standardmodell nicht auf Marktregulierung beschränkt, sondern auch staatliche Kernaufgaben intensiv reguliert. Ursache hierfür sind externe Effekte der Schaffung des gemeinsamen Binnenmarktes und das Fehlen eigenständiger Handlungsmittel in diesen Bereichen, das durch Regulierung kompensiert wird. Durch den vorherrschenden Modus der Regulierung bleiben die Eingriffe der EU aber weithin unsichtbar.
Although international police cooperation is not a new phenomenon and despite its relevance for the monopoly of force, studies applying a political science or international
relations (IR) perspective are scarce. Through a ‘competition of claims’, this article reviews and organizes current literature on cooperation in internal security to highlight crucial points of entry for IR- and political science approaches. While both claims argue along the lines of functionalist regime theory, the ‘informality claim’ stresses state’s interest to uphold autonomy and their accordant preference for informal cooperation. In contrast, the ‘institutionalization claim’ underscores the willingness of states to create formal and strong institutions as they promise effi ciency gains in light of transborder problems. By focusing on central issues in police cooperation (terrorism, drugs, money laundering, organized crime) this review highlights that internal security can become a prospering fi eld for IR- and political science theorizing.
Die Gesundheitssysteme der meisten westlichen Länder sind hauptsächlich auf die kurative Versorgung ausgerichtet. Sie funktionierten solange gut, wie die zu behandelnden Krankheiten tatsächlich geheilt werden konnten. Das ist heute wegen des Vorherrschens von chronischen Krankheiten, wegen individueller und sozialer Einflüsse auf Gesundheit und Krankheit nicht mehr der Fall. Deswegen gewinnen vorbeugende Strategien ebenso an Bedeutung wie krankheitsbegleitende Förderstrategien. Nur wenn sie stärker eingesetzt werden, kann auch der Wettlauf mit den steigenden Kosten der Versorgung gewonnen werden.
Dieses Lehrbuch hat sich in den ersten beiden Auflagen bereits bei der Ausbildung von angehenden Medizinern, Gesundheitswissenschaftlern, Pflegefachleuten und vielen anderen Gesundheitsprofessionen bewährt. Die dritte Auflage wurde gründlich überarbeitet, aktualisiert und ergänzt.
New Public Management has been around for a quarter of a century in European public sectors, yet despite the movement’s emphasis on indicators and evidence, there have been surprisingly few encompassing evaluations. In this paper, we provide an overview of academic evaluation and impact studies of entire NPM-style reform programmes. We distinguish between two sets of NPM-style changes and reforms. One is that of specific managerial innovations within public organisations. The other consists of changes to the role of government and citizens as a result of NPM ideas. We conclude that a majority of academic research has focused on the first set of changes, while approaches to the second set has been mainly of a critical nature with relatively limited attention for empirical studies.
Measuring Individual and Organisational Performance in the Public Services of EU Member States

This study compares and analyses the different individual and organisational performance assessment systems used by the public administrations of the Member States of the European Union (and Norway).
This publication presents an analysis and comparison of the various performance assessment systems in place, their objectives, working procedures, challenges and effects. The focus, therefore, is less on concepts and more on the actual practices of managers doing performance assessments.
The overall goal is to explore the main management challenges and success factors of implementing individual appraisal systems in public services in Europe. Based on deepening insights and practical experiences, the study intends to:
- make available up-to-date information on experiences across European public administrations;
- identify the main leadership challenges in successfully conducting individual assessments and linking them to organisational performance;
- present and discuss good practices in the field;
- provide practical guidance, by identifying the factors that will assist organisations in the design, implementation and revaluation of their systems in order to make performance assessments run more smoothly and contribute to improved organisational performance.
Another purpose of this comparative study is to present more empirical evidence on the relationship between the assessment of individual and organisational performance. What are the criteria used? What is the relationship between organisational performance and individual performance? How can organisational and individual performance be measured? What are the main challenges in measuring organisational performance and individual performance? Are recent reforms in the field of individual performance assessment enhancing organisational performance?
This paper considers the effects of fiscal governance in Central and East European countries 1998-2008. The first part makes predictions about which form of fiscal governance fits which form of government. Under multi-party coalition governments, fiscal contracts where governments make political commitments to multi-annual fiscal plans work well. In countries where two political blocks face off against one another, delegation based around a strong finance ministry should be most effective.
The second part examines electoral and party systems, which affect the form of government in place. The third part documents norms, rules, and institutions in place. The final section considers the joint effects of fiscal governance on fiscal outcomes. On balance, the underlying political climate is crucial for determining what types of fiscal norms, institutions, and rules function best. The more countries diverge from their expected form of fiscal governance, the greater the increase in a country’s debt burden.
Fiscal Governance in Europe

This book presents a theoretical framework to discuss how governments coordinate budgeting decisions. There are two modes of fiscal governance conducive to greater fiscal discipline, a mode of delegation and a mode of contracts. These modes contrast with a fiefdom form of governance, in which the decision-making process is decentralized. An important insight is that the effectiveness of a given form of fiscal governance depends crucially upon the underlying political system. Delegation functions well when there few, or no, ideological differences among government parties, whereas contracts are effective when there are many such differences. Based on original research, the book classifies European Union countries from 1985 to 2004. Empirically, delegation and contract states perform better than fiefdom states if they match the underlying political system. Additional chapters consider why countries have the fiscal institutions that they do, fiscal governance in Central and Eastern Europe, and the role of such institutions in the European Union.
We investigate the effect of fiscal institutions such as the strength of the finance minister in the budget process and deficits on interest rate spreads of Eurozone countries. Deficits significantly increase risk premia measured by relative swap spreads. The effect of deficits is significantly lower under EMU. This effect partly results from neglecting the role of fiscal institutions. After controlling for institutional changes, fiscal policy remains a significant determinant of risk premia in EMU. Better institutions are connected with lower risk premia. Furthermore deficits matter less for risk premia in countries with better institutions. Markets acknowledge that better institutions reduce fiscal difficulties rendering the monitoring of annual developments less important.
Auf dem Weg zu einem Informationssystem Zivilgesellschaft : Anspruch, Potentiale, Verknüpfungen

Die vorliegende Veröffentlichung ist der erste Band aus der Reihe »Zivilgesellschaft in Zahlen«, in welcher Fortschritte und Ergebnisse des gleichnamigen Projekts veröffentlicht werden. »Zivilgesellschaft in Zahlen« ist ein Gemeinschaftsprojekt des Stifterverbandes für die Deutsche Wissenschaft, der Bertelsmann Stiftung und der Fritz Thyssen Stiftung.
Ziel ist es, in Kooperation mit dem Statistischen Bundesamt und dem Centrum für soziale
Investitionen und Innovationen, die Grundlagen für eine Berichterstattung zu schaffen, die regelmäßig aktuelle Zahlen zu Entwicklungen und Trends in der Zivilgesellschaft in Deutschland liefert.
Im Rahmen des Workshops »Informationssystem Zivilgesellschaft« wurden Anforderungen und Potentiale für eine praxis- und politikrelevante Berichterstattung zur Zivilgesellschaft in Deutschland systematisch beleuchtet. Die Inhalte und Ergebnisse werden mit diesem Band dokumentiert. An Beispielen wird gezeigt, welche Beiträge thematisch relevante und angrenzende Daten- und Informationssysteme für ein umfassendes »Informationssystem Zivilgesellschaft« leisten können und welche Ansprüche aus Sicht der Politik, der Wissenschaft und der Zivilgesellschaft an ein solches Informationssystem gerichtet werden.
Globalizing policy fields can contain institutional voids in which effective regulatory frameworks and the corrective counterbalance of civil society are equally absent. With the inherently incomplete regulation of global finance on the one hand and the evident dearth of civil society institutions on the other, a central governance question emerges:
under what conditions could civil society help to recapture the financial system by embedding it in a wider social and economic policy, and thereby reversing the erosion of confidence in market capitalism and liberal democracy?
For this purpose, this article proposes the systematic development of a transnational civil society infrastructure in terms of organizational capacity and expertise for accountability enforcement, policy review, performance oversight and advocacy. The goal of this infrastructure is to fill the institutional void and form a counterveiling force against the unchecked might of global finance.
Aus dem Werk Dahrendorfs und der neueren Institutionentheorie schöpfend, soll hier am Beispiel der gegenwärtigen Wirtschafts- und Finanzkrise eine These verfolgt werden, die in ihrer Gesamtheit eine recht kritische Diagnose impliziert, aber dennoch auf Optionen im Sinne kreativer Politikgestaltung hinweist: »Die organisierte Zivilgesellschaft wird die transnationalen Konflikte des beginnenden 21. Jahrhunderts moderieren müssen, um der Überforderung von Staat und Markt in einer globalisierten Welt entgegenzuwirken«. Hierbei wird das globale Governance-Problem zentral angesprochen und die entscheidende Frage gestellt: Unter welchen Bedingungen könnte die Zivilgesellschaft ein ordnungspolitisches Korrigendum »von unten« werden, um die bruchstückhafte Struktur uniformer und universaler Regeln sinnhafter, tragfähiger und handlungswirksamer zu machen?
With this paper, we introduce the Marketing Strategy Conference approach to set strategic marketing priorities effectively and allocate marketing-related resources accordingly. The system is based on managerial preference modelling with a decision model (analytical side) and communication-enhancing strategy conferencing (interactive side). After a review of alternative resource allocation frameworks, as rule-of-thumb approaches, matrix-based analyses, statistical analyses and management science models, we analyse existing analytical, behavioural and organisational impediments to effective marketing resource allocation. Addressing some of these impediments, this paper outlines two Marketing Strategy Conference cases, which we carried out for the pharmaceutical company, Schering Argentina

This paper provides a comparative analysis of training regimes in Germany and the Netherlands. Both countries are CMEs with similar institutions, but their training regimes differ in important ways. The paper first maps the similarities and differences in the training regimes in both countries and then turns to three questions that frame the analysis of these similarities and differences. First, how have skills regimes adjusted to changes in economic and employment structure, such as de-industrialization and the rise of the service economy? Second, how much does the structure and adaptability of the raining regime help to explain the relative success of the Dutch employment miracle? Does the Dutch training regime represent successful institutional adaptation to changed economic circumstances? Conversely, does the inflexibility of the training regime contribute to the German employment malaise? Finally, what do these findings suggest for the analysis of the political economy of skills regimes in other CMEs?
Die Strategien der gesetzlichen Krankenkassen im Versicherungsmarkt und die Gesundheitsreform 2007

Dieses Policy Papier untersucht aus Sicht des Bundesministeriums der Finanzen (BMF) die Auswirkungen GKV-Wettbewerbsstärkungsgesetzes (GKV-WSG) auf den Wettbewerb der Gesetzlichen Krankenkassen. Der Schwerpunkt liegt dabei auf dem Versicherungsmarkt innerhalb der Gesetzlichen Krankenversicherung (GKV). Besondere Beachtung findet der im Rahmen der letzten Gesundheitsreform vereinbarte Bundeszuschuss für das deutsche Gesundheitswesen. Die Analyse kommt zu dem Ergebnis, dass durch das GKV-WSG keine effiziente und sachdienliche Verwendung der bereitgestellten Steuermittel sichergestellt wird. Im Versicherungsmarkt wird es aufgrund der Begrenzung des Zusatzbeitrages auf ein Prozent des Einkommens der Versicherten ohne eine Modifizierung der Überforderungsklausel zu erheblichen Wettbewerbsverzerrungen kommen. Die Wettbewerbsverzerrungen werden zu Effizienzverlusten und damit zu unnötigen Mehrausgaben in der Gesetzlichen Krankenversicherung führen. Das BMF sollte sich daher aktiv an der gesundheitspolitischen Debatte beteiligen und sich für die Abschaffung der Überforderungsklausel einsetzten. Alternative Modelle, die eine finanzielle Überforderung von Versicherten mit niedrigen Einkommen durch den Zusatzbeitrag verhindern, sollten hinsichtlich ihrer ordnungs- sowie finanzpolitischen Wirkung untersucht und gegebenenfalls in die Diskussion eingebracht werden. Die Ausgestaltung des morbiditätsorientierten Risikostrukturausgleichs sollte kritisch begleitet werden.
Verfassungen beschränken den Spielraum zukünftigen Handelns. Durch Selbstbindung schützen sich Akteure, so scheint es, vor sich selbst, d. h. vor den selbstverursachten Handlungsfolgen, die sie sonst zu bedauern hätten und vor denen sie diese Selbstbindung verschont. So gesehen steigern Akteure sogar ihr Handlungspotential,wenn sie sich selbst binden und dadurch, unbeeinträchtigt durch eigene Fehler, weiter handeln und mit anderen Akteuren in eine beiderseits kalkulierbare Kooperation treten können. Dieser wohltätige Zusammenhang von Selbstbindung und Freiheit ist immer schon am klugen Umgang des Odysseus mit den Verlockungen der Sirenen gerühmt worden. Der Beitrag untersucht am Beispiel von Elsters Analyse der postsozialistischen Verfassungspolitik, dass und warum der ve rmeintliche Segen einer kollektiven Selbstbindung bei der Gründung einer ne uen konstitutionellen Ordnung nur sehr bedingt zur Geltung kommt.
This report seeks to examine major changes that occurred in the last 10 years in the UK in the sphere of family policies, or more specifically, the introduction of policies aimed at the reconciliation of working and family life. The changes were addressed from two perspectives. On the one hand, Peter Hall’s concept of three different types of changes in policy – change in levels of existing instruments, changes to the instruments themselves, and changes in policy goals, has been employed, and a conclusion reached that there has been a paradigmatic shift: policy goals themselves changed. Family welfare and reconciliation of work and family life became legitimate policy goals. The other approach was to look at the changes from the perspective of gendered welfare state discussions, and ask the question in what way has the character of the UK gendered welfare state changed – specifically concerning state support for a different division of care and paid labour between men and women? The preliminary conclusion is that new UK policies make a beginning commitment in this respect but fall short of effectively encouraging major change: they do facilitate the reconciliation of work and family for women, but still provide moderate to weak levels of support for the involvement of men in child-rearing.
