Four phases of the discussion can be distinguished: Before World War I, in the rivalry between Germany and England, the debate begins. Across the spectrum, from the liberal Adolf Weber to the Marxist Rudolf Hilferding and the eclectic Joseph Schumpeter, comparisons were made, and the heterogenous authors arrived at similar assessments. During the Cold War, in contrast to the Soviet-Russian model, Alexander Gerschenkron's depiction with the advantages of backwardness became influential. After the 1990s and in line with the Varieties of Capitalism approach, the discussion led by Ross Levine resulted in a consensus where different financial systems were embedded in their broader institutional context. The current discussion attempts to prove the superiority of capital markets, pointing to the American system as example.}, language = {de} } @article{HoferLeicher2024, author = {Hofer, Jan and Leicher, Darian}, title = {From Core Business to By-product : Why German Media Companies Still Invest in Journalism}, series = {Studies in Media and Communication}, volume = {12(2024)}, journal = {Studies in Media and Communication}, number = {No. 4}, doi = {10.11114/smc.v12i4.7000}, url = {http://nbn-resolving.de/urn:nbn:de:hbz:1010-opus4-46336}, pages = {1 -- 9}, year = {2024}, abstract = {The emergence of digital technologies over the past two decades has brought about changes that threaten the very existence of german media companies. The journalistic business model is losing sales, and the decline in print circulations is making it successively difficult to earn money with journalistic products. Therefore, german media companies have been investing in business models that have no relation to journalism to generate growth for years - with success. Considering this development, it is astonishing from a purely economic perspective that media groups, which are increasingly developing into technology companies, are still clinging to the ailing journalistic business model at all. To examine their motives to do so, this study poses the following research question: "Why do media companies still invest in journalistic products today?" To answer it, the researcher conducted interviews with highlevel employees from media companies as part of a qualitative study. Analysis of the data revealed that media companies continue to invest in journalism mainly because they benefit economically from the brands their journalistic products represent. Other reasons like serving as a pillar of the democratic constitution or to help shape public discourse seem to be less important.}, language = {en} } @unpublished{Greitens2024, author = {Greitens, Jan}, title = {Die europ{\"a}ische Sustainable Finance-Regulierung und der deutsche Mittelstand}, volume = {2024}, url = {http://nbn-resolving.de/urn:nbn:de:hbz:1010-opus4-46111}, pages = {12}, year = {2024}, abstract = {The European Sustainable Finance regulation is primarily focused on capital markets, requiring companies to disclose extensive data. An evaluation was conducted to ascertain the influence of the formulation process and the presence of the insert on the mechanical behavior with regard to tensile strength. The aluminum matrix was obtained from commercial and scrap alloys, elaborated by advanced methods of degassing and chemical modification. Meanwhile, the steel mesh reinforcement was cleaned, copper plated, and preheated to optimize wetting and, consequently, adhesion. The structural characterization was performed by scanning electron microscopy (SEM) and energy dispersive X-ray spectroscopy analyses (EDX), which highlighted a well-defined interface and uniform copper distribution. The composite was produced by means of horizontal-axis centrifugal casting in a fiberglass mold, followed by cold rolling to obtain flat specimens. A total of eight tensile specimens were examined, with measured ultimate tensile strengths ranging from 78.5 to 119.8 (MPa). A thorough examination of the fractured specimens revealed a brittle fracture mechanism, devoid of substantial plastic deformation. The onset of failures was frequently observed at the interface between the aluminum matrix and the steel mesh. The use of SEM and EDX investigations led to the confirmation of the uniformity of the copper coating and the absence of significant porosity or interfacial defects. A bimodal distribution of tensile strength values was observed, a phenomenon that is likely attributable to variations in mesh positioning and local differences in solidification. A correlation was established between the experimental results and an analytical polynomial model, thereby confirming a reasonable fit. In sum, the present study provides a substantial foundation for the development of metal matrix composites with enhanced performance, specifically designed for challenging structural applications. This method also demonstrates potential for recycling aluminum scrap into high-performance composites with controlled microstructure and mechanical integrity.}, language = {en} } @article{Wienbracke2024, author = {Wienbracke, Mike}, title = {Keine Entsch{\"a}digung f{\"u}r coronabedingte Einnahmeausf{\"a}lle eines Berufsmusikers w{\"a}hrend des ersten Lockdowns}, series = {Entscheidungen zum Wirtschaftsrecht (EWiR)}, volume = {40 (2024)}, journal = {Entscheidungen zum Wirtschaftsrecht (EWiR)}, number = {4}, pages = {115 -- 117}, year = {2024}, language = {de} } @article{Wienbracke2025, author = {Wienbracke, Mike}, title = {„Schriftliches Einverst{\"a}ndnis" mit Flugscheinkostenerstattung in Form von Reisegutscheinen durch konkludentes Verhalten : EuGH, Urteil vom 16.1.2025 - C-642/23 (LG D{\"u}sseldorf) ; This cost reduction is achieved by means of several mechanisms. First, because of the optimization of the design and installation process of current PV projects, and second, by the optimization, in terms of performance, in the manufacturing techniques and material combinations within the modules, which also has an impact on both, the installation process, and the levelized cost of electricity (LCOE). One popular trend is to increase the power delivered by photovoltaic modules, either by using larger wafer sizes or by combining more cells within the module unit. This solution means a significant increase in the size of these devices, but it implies an optimization in the design of photovoltaic plants. This results in an installation cost reduction which turns into a decrease in the LCOE. However, this solution does not represent a breakthrough in addressing the real challenge of the technology which affects the module requirements. The innovation efforts must be focused on improving the modules capability to produce energy without enlarging the harvesting area. This challenge can be faced by approaching some of the module characteristics which are summarized in this chapter.}, language = {en} } @article{Wienbracke2024, author = {Wienbracke, Mike}, title = {EuGH: Konstruktionsfehler als „außergew{\"o}hnlicher Umstand" (Art. 5 III VO Nr. 261/2004) (EuGH, Regionalgericht Warschau 13.06.2024 - C-411/23) - II}, series = {Gesellschafts- und Wirtschaftsrecht (GWR)}, volume = {16 (2024)}, journal = {Gesellschafts- und Wirtschaftsrecht (GWR)}, number = {16}, publisher = {Beck}, pages = {268}, year = {2024}, language = {de} } @article{Wienbracke2024, author = {Wienbracke, Mike}, title = {Ausgleichszahlung nach FluggastrechteVO bei vorweggenommener Bef{\"o}rderungsverweigerung auch ohne rechtzeitiges Einfinden zur Abfertigung (EuGH 26.10.2023 - C-238/22)}, series = {Gesellschafts- und Wirtschaftsrecht (GWR)}, volume = {16 (2024)}, journal = {Gesellschafts- und Wirtschaftsrecht (GWR)}, number = {4}, pages = {54}, year = {2024}, language = {de} } @article{Wienbracke2024, author = {Wienbracke, Mike}, title = {Gesamtpreis im Sinne der PAngV enth{\"a}lt nicht den beim Kauf von Waren in Pfandbeh{\"a}ltern zu entrichtenden Pfandbetrag (BGH 26.10.2023 - I ZR 135/20)}, series = {Gesellschafts- und Wirtschaftsrecht (GWR)}, volume = {16 (2024)}, journal = {Gesellschafts- und Wirtschaftsrecht (GWR)}, number = {3}, pages = {42}, year = {2024}, language = {de} }
