The effects of patent attorney use on filing strategy vis-a-vis the effects of firm experience JF - Management Decision N2 - PurposeIn the intellectual property (IP) and management literature, the question of how external patent attorneys impact patent filings has been understudied. The purpose of this paper is to advance this area of research by examining how the use of external patent attorneys influences the patent filing strategies of firms and what impact firms? level of experience with the exclusive use of in-house resources has on filing strategies. This study, thus, provides insights into the strategic dimension behind patent filing, a process which is affected by patent attorneys? work and decision-making processes.Design/methodology/approachThe econometric analysis is based on a patent database of 922,553 patents which is combined with an EPO patent database covering applications from 1990 to 2010. The authors test the hypotheses for this study using patent indicators addressing the impact of in-house firm experience vs the use of external patent attorneys on firm?s filing strategy.FindingsThis research finds empirical evidence that external patent attorneys? work has an effect on patent scope, international scope, and patenting speed. Moreover, it can be shown that external patent attorneys have a positive impact on most filing dimensions, such as patent scope, international scope and the Patent Cooperation Treaty option, whereas the level of in-house firm experience has a negative impact on most filing dimensions. This implies that external patent attorneys seem to pursue a ?maximization approach? while experienced firms seem to pursue a more differentiated approach to filing patents, for instance, drafting narrower and more focused patents.Practical implicationsThe study suggests that effective filing strategies require an integrated approach between diverse IP stakeholders. More particularly, filing strategies should be communicated and aligned between all actors, including external patent attorneys in order to achieve the targeted patenting output.Originality/valueThe current study develops a patent filing typology, which accounts for patent attorneys? decision options. In providing insights into patent attorneys? work and their impacts on intellectual property rights management, the study is a useful complement to prior research, which has predominantly focused on applicants or examiners. Alle wichtigen Patentämter weltweit sind mit einer regelrechten "Explosion von Patentanmeldungen" konfrontiert (Harhoff et al., 2007). Die Rolle von geistigem Eigentum - englisch: Intellectual Property (IP) - vor allem von Patentmanagement hat sich von einem rein rechtlichen Konstrukt, hin zu einem Bereich von strategischer Bedeutung entwickelt. Obwohl Fragestellungen in Hinblick auf strategisches Patentmanagement zuletzt Gegenstand zunehmender Forschung und Praxis geworden sind, mangelt es bislang an dedizierter Forschung zu IP Outsourcing und deren Einfluss auf das Management von Patenten. Aus diesem Grunde, untersucht meine Dissertation empirisch folgende wichtige Fragestellungen: Wie Firmen Outsourcingstrategien definieren, welche Typen von IP Intermediären im Umfeld von IP existieren und wie diese IP Intermediäre die IP Strategien von Unternehmen beeinflussen. Meine Dissertation besteht aus einem Einleitungskapitel und drei individuellen Forschungsartikeln. Das Einleitungskapitel erläutert die Motivation der Arbeit und gibt einen Überblick über den aktuellen Stand der Forschung. Desweiteren untersuchen die nachfolgenden drei Artikel spezifische Forschungsfragen zum Thema IP Outsourcing und dem Management von IP unter Zusammenarbeit mit IP Intermediären. Der erste Artikel betrachtet das Phänomen IP Outsourcing näher und analysiert Unternehmensstrategien in Bezug auf IP Outsourcing. Der zweite Artikel fokussiert sich auf IP Intermediäre, indem unterschiedliche IP Dienstleister vorgestellt werden und sowohl Motive, als auch Determinanten für die Auswahl von IP Dienstleister untersucht werden. Der letzte Artikel befasst sich mit der Frage, wie externe Patentanwälte und deren Erfahrung auf die Patentanmeldestrategie von Unternehmen Einfluss nehmen. This paper aims to contribute to the IP literature in two ways. First, a definition of the IP service provider is proposed. Second, I consider three main hypotheses that determine a firm's preference for outsourced IP work. Using data on the outsourcing of patent renewal payments, I found evidence that the choice of IP supplier is affected by: (1) the firm's own IP maintenance capabilities, (2) the firm's IP knowledge utilization, and (3) the IP complexity. The fierce rejection of 1st generation design methods in the early 1970s resulted in the postmodernist attitude of "no methods", and subsequently, after more than a decade, in the strong adoption of scientific methods, or "the" scientific method, for design research. The current situation regarding methodology is characterized by unproductive dualisms such as scientific methods vs. designerly methods, normative methods vs. descriptive methods, research vs. design. The potential of the early (1st generation) methods is neglected and the practical usefulness of design research is impeded. The suggestion for 2nd generation methods as discussed by Rittel and others has hardly been taken up in design. The development of a methodological tool / medium for research through design – MAPS1 – (which is the central part of the paper) presents the cause and catalyst for some reflections about the usability / desirability / usefulness of methodical support for the design (research) process. Here, we compare two promising designs to build solid-state electronic devices utilizing the same functional unit. Optically addressable Ru-terpyridine complexes were incorporated in supramolecular wires or employed as ligands of gold nanoparticles and contacted by nanoelectrodes. The resulting small-area nanodevices were thoroughly electrically characterized as a function of temperature and light exposure. Differences in the resulting device conductance could be attributed to the device design and the respective transport mechanism, that is, thermally activated hopping conduction in the case of Ru-terpyridine wire devices or sequential tunneling in nanoparticle-based devices. Furthermore, the conductance switching of nanoparticle-based devices upon 530 nm irradiation was attributed to plasmon-induced metal-to-ligand charge transfer in the Ru-terpyridine complexes used as switching ligands. Finally, our results reveal a superior device performance of nanoparticle-based devices compared to molecular wire devices based on Ru-terpyridine complexes as functional units. Depending on the requirements there are a great number of possible design versions. The planner has to consider not only the present but also the future requirements. Up to now, the planner decides on the basis of experience which system will perform the requested services best. This paper illustrates the redesign of a new order-picking system in industry supported by a simulation tool of our institute designed especially for the rough planning. With the described project the road capability of the applied simulation concept is underlined. Several versions based on the requirements were investigated and evaluated. Key figures are calculated and a recommendation depending on performance and arising expenses is given. As in real-world MR systems, the number of containers to deliver in each interval varies in the short term, peaks in the number of deliveries may lead to capacity bottlenecks and late deliveries. In this paper, we develop three alternative strategies to determine starting times of MR cycles in real-time based on the current number of delivery orders in the system aiming to better handle variations in the number of orders. We evaluate the three strategies for different system load scenarios with respect to delivery service levels, order lead times, systems utilization and necessary number of MR trains using a discrete-event simulation model. Was sind die grundlegenden Kräfte die auf Clavicula und Implantat wirken und welchen Einfl uss hat die Bruchform. Methodik Die Muskel- und Gelenkkräfte sowie die Belastung des Implantatverbundes wurden mit einer muskuloskelletalen Simulationssoftware (AnyBody Technology, V.4) berechnet. Hierfür wurden mit einem komplexen Model des menschlichen Körpers folgende Bewegungen analysiert: eine Flexion von 160° und Abduktion 160° mit einem Gewicht von 2 kg in der Hand. Aus CT-Patientendaten wurden zwei dreidimensionale Modelle des Clavicula-Implantat Verbundes gebildet, die sich in der Frakturform unterscheiden (Querfraktur und vertikale Fraktur). In beiden Modellen wurde eine Claviculaosteosynthese in superiorer Position mit einer 6 Loch LCP mit 2 Schrauben pro Hauptfragment verwendet. Die Materialeigenschaften wurden aus der Dichte des Materials sowie aus Literaturdaten verwendet. Die Muskel- und Gelenkkräfte aus der muskuloskelletalen Berechnung wurden auf das Finite Elemente Modell übertragen und die Spannungen und Dehnungen des Implantat-Knochenverbundes wurden berechnet. Ergebnisse Es zeigte sich, dass die simulierte in vivo Belastung stark abhängig vom Flexionswinkel ist. Das Implantat ist in der superioren Lage auf Biegung belastet, welche maximale Werte im Überschulterniveau erreicht. Die Bruchform mit anatomischer Reposition und Kontakt der Hauptfragmente zueinander führt zu einer deutlichen Entlastung des Osteosyntheseverbundes im Vergleich zu einer Bruchform mit vertikaler Fraktur. Schlussfolgerung Aus den Analysen ist eine Positionierung der Plattenosteosynthese für die im mittleren Drittel frakturierte Clavicula in anterior-superiorer Lage wünschenswert. Die anatomische Reposition entlastet den Osteosyntheseverbund und sollte möglichst erreicht werden. Die Nachbehandlung sollte ein Bewegungsausmaß für den Arm für 4 Wochen für einfache Bruchformen auf 70° Flexion und Abduktion limitieren und für komplexe Bruchformen diese Limitierung ausgedehnt werden. Weak excitation by a femtosecond-laser pulse results in the melting of the CDW. The immediate freezing is hindered by a barrier for the motion of atoms during the phase transition: The melted CDW constitutes a long-lived, supercooled phase and is strong evidence for a first-order transition. The freezing into the CDW is triggered by preexisting adsorbates. Starting at these condensation nuclei, the CDW expands one dimensionally on the In/Si(111) surface, with a constant velocity of more than 80 m/s. The surfaces are excited by an intense fs-laser pulse (pump) and probed by an ultra-short electron pulse with variable time delay. The order-disorder phase transition from a c(4 × 2) to a(2 × 1) of the bare Si(001) surface shows a transient decrease of the intensity of the c(4 × 2) spots which recovers on a time scale of a few hundred picoseconds indicating the excitation of the phase transition. On Si(111) a monolayer of Indium induces a (4 × 1) reconstruction which undergoes a Peierls like phase transition to a (8 × "2") reconstruction below 100 K. Upon laser excitation with a fluence of 3.4 mJ/cm 2 at a temperature of 72 K the phase transition was strongly driven. The (8 × "2")-diffraction spots instantaneously disappears, while the intensity of the (4 × 1)-spots increases. This increase of the (4 × 1) spot intensity excludes an explanation by the Debye-Waller-Effect and is evidence for a true structural phase transition at a surface. © 2010 Materials Research Society. From the exponential decay of the surface temperature evolution a thermal boundary conductance of 1430 W/(cm2K) is determined for a 9.7 nm thin Bi(111) film on Si(111). A linear dependence between laser fluence and initial temperature rise was measured for film-thicknesses between 2.5 nm and 34.5 nm. The ratio of initial temperature rise and laser fluence for different film-thicknesses is compared to a model taking multilayer optics into account. The data agree well with this model. From the variation of the spot profiles with the vertical scattering vector we determine the hetero film roughness, the change of interlayer spacing due to tetragonal distortion, and the variation of the interlayer distance due to partial relaxation of the strained rough film. The practical implementation of this method is simple and can be used to determine the onset of strain-relieving defects during the growth process. Ultrafast optical-pump, X-ray diffraction probe experiments are providing new ways to study transient processes including the direct observation of the atomic motion by which many solid-state processes and chemical and biochemical reactions take place. Current table-top-terawatt femtosecond laser systems provide an attractive source of few-hundred femtosecond duration bursts of angstrom-scale X-ray radiation with fluxes comparable to standard rotating anode sources. Their compact size enables time resolved structural dynamics to be studied in the small laboratory with temporal resolution better than typical molecular vibrational periods. Ultrafast structural dynamics in crystalline samples are readily studied with such systems and experiments to be discussed in this talk include ultrafast non-thermal solid-to-liquid transition in thin single-crystal Ge-111 films grown on Si-111 substrates; ultrafast non-thermal solid-to-solid transitions in bulk vanadium dioxide from a low temperature insulating phase to a high temperature metallic phase; and harmonic and anharmonic coherent acoustic dynamics in layered Ge-111/Si-111 and bulk GaAs-111 samples. Future improvements in high-average power short-pulse lasers will enable the study of a wider class of materials such as amorphous solids or liquid-phase dynamics of simple molecules, while proposed 4th generation light sources based upon single-pass X-ray free-electron lasers will permit singleshot structural determination of complex biomolecules. The timescale of interest is in the range 10(-14) to 10(-12) s. Until recently, only optical techniques were capable of providing adequate time resolution, albeit with indirect sensitivity to structural arrangement. Ultrafast laser-induced changes of long-range order have recently been directly established for some materials using time-resolved X-ray diffraction. However, the measurement of the atomic displacements within the unit cell, as well as their relationship with the stability limit of a structural phase, has to date remained obscure. Here we report time-resolved X-ray diffraction measurements of the coherent atomic displacement of the lattice atoms in photoexcited bismuth close to a phase transition. Excitation of large-amplitude coherent optical phonons gives rise to a periodic modulation of the X-ray diffraction efficiency. Stronger excitation corresponding to atomic displacements exceeding 10 per cent of the nearest-neighbour distance-near the Lindemann limit-leads to a subsequent loss of long-range order, which is most probably due to melting of the material.
