Agreement on the Release of Academic Publications Via the OPUS Publication Server Operated by HTW Berlin
§ 1 Granting of Rights
The author grants HTW Berlin, represented by the University Library, the non-exclusive, perpetual and irrevocable right to make the publication, including abstracts and metadata, publicly accessible free of charge in accordance with the licence conditions set out in this agreement, to archive it on the publication server OPUShtw operated by HTW Berlin and to reproduce it for the present purposes.
Users are authorised to use, save, download and print out a limited number of the documents free of charge for private and other personal use, this in accordance with German copyright law (§53 UrhG).
HTW Berlin reserves the right to reject publications due to technical or content-related deficiencies or for legal reasons.
The rights granted under this agreement may be transferred in whole or in part to third parties. Simple rights of use may be granted to third parties (e.g. other archives) without the author’s separate consent being required. This serves to secure the content in the long term and to ensure technical accessibility and usability.
In the case of works written by several authors, the co-author also confirms that they have informed all other co-authors of the planned publication. These individuals have all agreed to this publication.
In addition to the provisions contained in this agreement, authors may grant a corresponding open content licence and thus transfer certain rights of use to the general public. In accordance with its Open Access Policy HTW Berlin recommends the use of a CC BY licence. Further information can be found on the Licences page of the University Library.
§ 2 Long-Term Archiving and Conversion into Other Formats
The author grants HTW Berlin the right to store the documents provided by them in a long-term archive and, if necessary (e.g. due to migration, accessibility, better accessibility or indexing), to convert them into other electronic and physical formats.
In addition, they hereby grant HTW Berlin the right to make the publication available to third parties for the purpose of long-term archiving or online provision.
§ 3 Disclosure of Metadata and Abstract
The author grants HTW Berlin the right to correct and complete the metadata if necessary and to make it available to other databases free of charge under the terms of the CC0 1.0 Universal License (CC0 1.0). They hereby also grant HTW Berlin a permanent, non-exclusive right of use to the provision and distribution of the abstract of their document.
§ 4 Third-Party Rights and Liability
The author:
(1) declares that they are not infringing any third-party rights (e.g. co-authors, publishers, third-party funders) by publishing the publication and its components (e.g. illustrations). The authors affirms that they are authorised to grant HTW Berlin the above-mentioned rights to the work, and confirms that no exclusive rights of use to the work have been transferred to third parties (e.g. publishers).
(2) confirms that the generally recognised rules and criteria of scientific work and good scientific practice have been observed in the creation of the work.
(3) confirms that they will inform HTW Berlin immediately in the event of legal doubts or obstacles. HTW Berlin shall be authorised to block access to a publication in the event that concrete evidence of a violation of third-party rights is found to exist.
(4) undertakes to indemnify HTW Berlin against all third-party claims resulting from the fact that the publication of their work on the OPUShtw repository leads to an infringement of copyrights or exclusive rights of use due to a culpable misrepresentation on the part of the author regarding the non-existence of third-party rights or other circumstances for which they may be held responsible. As the operator of OPUShtw, HTW Berlin is only liable for violations resulting from intentional or grossly negligent behaviour on its part. In the latter case, the damage is apportioned, with a weighting of the shares of liability. The contracting parties undertake to inform each other immediately in the event that third parties assert copyrights or rights of use to the work to which they are entitled.
(5) confirms that the publication does not contain any personal data belonging to third parties that are subject to data protection and/or that the necessary consents under data protection law have been obtained.
§ 5 Blocking of the Publication
In special exceptional cases, the author or co-author may request the blocking of their publication if this is also in the interest of HTW Berlin. A publication will only be enforced after such an application has been approved by the University Library.
