What capacities do states need to deal with the challenges of the contemporary age? How can the capacity of public administration be enhanced to meaningfully contribute to public problem-solving? Gerhard Hammerschmid and Tamyko Ysa Global diffusion of an Anglo-Saxon concept The idea of public–private partnership (PPP) as a model for public procurement and financing public investments arrived on a wave of public management modernization issues in the early 1990s in Europe and was first implemented on a broader basis in the UK under the Private Finance Initiative (PFI). A European Investment Bank (2007) report clearly shows that the UK is still a forerunner in terms of both number of PPP projects and volume. Out of a cumulative value of €194.7 billion that has been signed up until the end of 2006, the UK accounts for 57.7 per cent. However, it is also clear that the UK market is maturing (e.g. Ysa, 2007), whereas the rest of the European PPP market is growing. International organizations such as the World Bank, the OECD and the International Monetary Fund, together with multinational professional companies (e.g. PwC, 2005; Deloitte, 2006a, 2006b; DLA Piper, 2007; Ernst & Young, 2008), played an important role in the international diffusion of PPPs both as promoters and as knowledge carriers. Within Europe especially, the European Commission has given a strong impetus in a similar form when launching a Green Paper on PPPs in 2004 (European Commission, 2004). PPPs have raised high expectations among scholars, governments and practitioners in Europe alike. Based on an executive survey this article analyses the extent to which a new managerial logic has replaced traditional administrative values and identity in Austria. We do not find any strong evidence of a new managerial logic but rather modifications, local translations and the emergence of a hybrid identity.

Stiftung Mercator staged a round-table discussion on the topic of Cultural Diplomacy, China and the Roles of Foundations. This special publication picks up on and addresses in greater detail the topics and results of the round-table discussions. The chapter situates governance innovations within the broad innovation literature. It offers a multi-dimensional concept of innovations; reviews causes and conditions for innovation such as innovator characteristics and innovation systems; highlights the interdependent relationship between innovation and isomorphism; and identifies the main characteristics of innovations in the realm of governance. Our engagement with the literature reveals seven propositions and hypotheses that can guide research on governance innovations in the future.

The chapter examines the evolution of governance arrangements in the global financial system through the lens of governance innovation. It explores the interplay between financial crisis and the emergence and increasing complexity of the current international system, compares governance innovation in finance to fiscal and monetary policy, and addresses the potential for a radical break from the status quo.
Widerstand wird in der Regel nicht staatlich organisiert, auch nicht in der Demokratie. Wer an Widerstand denkt, der denkt an Straßenproteste, Sitzblockaden, aber auch subtilere Versuche, Einfluss zu nehmen auf den öffentlichen Diskurs, politische Alternativen zu formulieren und Menschen zu bewegen, sich für politischen Wandel einzusetzen.
Nach vier Jahren Vorarbeiten ging im Herbst 2008 das Beziehungs- und Familienpanel (pairfam) ins Feld. Die Beiträge dieses Sammelbandes stellen Ergebnisse auf Grundlage der Daten der ersten Welle der interessierten Fachöffentlichkeit vor.
Die ersten beiden Beiträge geben eine Einführung in die pairfam-Daten. Die Ziele und das Design des Projekts werden im ersten Beitrag vorgestellt. Der praktische Umgang mit den Daten wird im zweiten Beitrag erläutert. Die restlichen Beiträge stellen inhaltliche Resultate vor. Sie befassen sich mit Themen, die in Zeiten rasanten familialen Wandels hoch interessant sein dürften. Vier Beiträge stammen aus der Partnerschaftsforschung: Partnermärkte und Partnersuche, Institutionalisierungsprozesse von Partnerschaften und die Effekte von feindseligen Attributionen auf Partnerschaftskonflikte werden untersucht. Weitere vier Beiträge untersuchen Entscheidungen über die Familienplanung aus unterschiedlichen Perspektiven: Nicht-eheliche Geburten, institutionelle Rahmenbedingungen, die Effekte der Religion und partnerschaftlicher Entscheidungen sind die Themen. In fast allen europäischen Ländern bleiben heute mehr Männer und Frauen kinderlos als vor zwei oder drei Jahrzehnten. In Westdeutschland werden voraussichtlich mehr als 20 Prozent der 1965 geborenen Frauen und möglicherweise 30 Prozent der höher gebildeten Frauen des gleichen Jahrgangs ohne eigene Kinder bleiben. Das Thema Kinderlosigkeit hat in der jüngsten Zeit eine erhebliche öffentliche Aufmerksamkeit erweckt, jedoch steht die in Medien und Politik geführte Debatte auf wackeligen Füßen. Die dort verwendeten Zahlen zum Ausmaß der Kinderlosigkeit von Männern und Frauen in unserer Gesellschaft gehen weit auseinander und die vermuteten Ursachen der hohen Kinderlosigkeit in Deutschland sind widersprüchlich. Sind wirtschaftliche Unsicherheiten, schlechte Bedingungen der Vereinbarkeit von Familie und Beruf oder einseitig karriereorientierte Lebenskonzepte von Frauen, insbesondere Akademikerinnen, für die hohe Kinderlosigkeit verantwortlich? Der Beitrag gibt einen Überblick über die Potentiale des Sozio-oekonomischen Panels (SOEP) und des Mikrozensus für kontextuelle Analysen im Bereich der Bildungsforschung. Wir betrachten die Möglichkeiten und auch Grenzen, welche mit diesen beiden Datensätzen verbunden sind. Sie heben sich dadurch hervor, dass eine Berücksichtigung des Familien- und Haushaltskontextes möglich ist und die Datensätze in unterschiedlichem Ausmaß die Abbildung von institutionellen und regionalen Kontexten zulassen. Die Datensätze weisen unterschiedliche Stärken auf, die sich auch aus den hohen Fallzahlen des Mikrozensus oder der längsschnittlichen Betrachtung von Haushalten im SOEP ergeben. Da die verfügbaren Daten bis in die 1970er bzw. 1980er Jahre zurückreichen, bieten beide Datensätze Potentiale zur Analyse des Bildungsverhaltens in sich wandelnden Kontexten. Im Beitrag werden Analysebeispiele aus dem Bereich der frühen Bildung vorgestellt. In einem Ausblick diskutieren wir kurz zukünftige Analysepotentiale der Datensätze.

While scholarly writing has dealt with the role of law in the process of European integration, so far it has shed little light on the lawyers and communities of lawyers involved in that process. Law has been one of the most thoroughly investigated aspects of the European integration process, and EU law has become a well-established academic discipline, with the emergence more recently of an impressive body of legal and political science literature on 'European law in context'. Yet this field has been dominated by an essentially judicial narrative, focused on the role of the European courts, underestimating in the process the multifaceted roles lawyers and law play in the EU polity, notably the roles they play beyond the litigation arena. This volume seeks to promote a deeper understanding of European law as a social and political phenomenon, presenting a more complete view of the European legal field by looking beyond the courts, and at the same time broadening the scholarly horizon by exploring the ways in which European law is actually made. Europe’s economic constitution in crisis and the emergence of a new constitutional constellation

This discussion of the ECJ in the context of a project on political representation in the EU responds to the Court’s changing functions in the integration process and also to the critique which the exercise of this function has provoked in recent years after the Court objected to constitutional provisions and legislation of constitutional status in particular in the sphere of labour law and social protection. The ECJ has been accused of partisanship with a neoliberal-monetarist agenda. These debates are bound to extend to the new functions which were assigned to the CJEU in the supervision of the budgetary discipline of Member States in the Euro zone. The problems that might arise in such a case have been foreshadowed by the recent jurisprudence on the legality of the European practices of crisis management. The judgments of the German Bundesverfassungsgericht of 12 September 1212 on the ESM Treaty and the Fiscal Compact and the CJEU Judgment of 27 November 2012 in the Pringle case are of exemplary importance. They document the difficulties both courts have with the defense of the autonomy of law against apparent functional necessities and concurring attitudes in the readiness to accept the primacy of the political.
This book collects a large number of essays written in honour of Professor Ernst-Ulrich Petersmann by his friends, colleagues and former students. Ob sich tatsächlich ein Paradigmenwechsel vom Korporatismus zum Lobbyismus vollzieht, wie verschiedentlich diagnostiziert, oder ob die Interaktion von Staat und Verbänden künftig zwischen diesen beiden Polen oszilliert, ist Thema dieses Buches. Zugleich ist es als Fallstudie zur österreichischen Sozialpartnerschaft und als vergleichende Analyse der Entwicklung in den "alten" und "neuen" Mitgliedsstaaten der EU angelegt.

Die amerikanische Frankreichforschung ist außerordentlich vielfältig, umfangreich und kreativ. Einen systematischen Überblick darüber zu geben, bedürfte eines längerfristigen Forschungsprojektes. In diesem Artikel kann es nur darum gehen, schlaglichtartig einige Aspekte aufzuzeigen, einige Zentren und Schwerpunkte zu benennen und vielleicht ein wenig Problembewußtsein für die Notwendigkeit zu schaffen, sich stärker als bisher bei uns damit zu beschäftigen. Die Beleuchtung der internationalen Dimension der Frankreichforschung ist eine unter vielen Aufgaben dieses Frankreich-Jahrbuchs.
Der Begriff Governance ist ein Erfolgsbegriff und zwar nicht nur in der Politikwissenschaft, sondern auch in anderen Disziplinen, selbst in der eher begriffskonservativen Rechtswissenschaft. Der Preis dieses Erfolges ist die Uneindeutigkeit des Governancebegriffs, was die Governance-Forschung dazu zwingt, sich über die Begriffsverwendung von Governance zu verständigen und die Verwendungskontexte des Governancebegriffs analytisch sorgfältig auszudifferenzieren. Zu beidem will dieses PVS-Sonderheft einen weiterführenden Beitrag leisten. In den Beiträgen der Herausgeber und im ersten Teil des Bandes geht es um erste Konturen einer Theorie von Governance und die Präzisierung des Governancebegriffs. Der Abgrenzung und Schärfung des Governancebegriffs dienen ferner die Beiträge, die sich mit dem Verhältnis zum historisch so dominanten Organisationsprinzip der Hierarchie auseinandersetzen. Mit dem Teil „Governance und Recht“ wird gezielt ein multidisziplinärer Dialog über das Governance-Konzept eröffnet, und zwar in der Hoffnung, daraus gerade für ein Verständnis von Governance als Koordination von Akteurshandeln in Regelungsstrukturen zu lernen. Die den Governanceebenen gewidmeten Teile – von „National“ zu „Transnational“ Governance – beschäftigen sich mit unterschiedlichen Governance-Kontexten und unterschiedlichen Governance-Modi wie etwa Netzwerken und Public Private Partnerships. Sinn des Bandes ist also weniger eine Bestandsaufnahme der Governance-Forschung, sondern eine Verortung von Governancestrukturen und Governanceprozessen vor dem Hintergrund sich wandelnder Staatlichkeit.

Das Werk legt eine Bestandsaufnahme der Leistungsfähigkeit der politikwissenschaftlichen Teildisziplin der Internationalen Beziehungen (IB) vor.
Es wird gefragt, inwieweit im deutschsprachigen Raum eigenständige Forschungsakzente entwickelt wurden, zu welchen Erträgen diese geführt haben und inwieweit das Fachgebiet in der Lage ist, die realen Veränderungen konzeptionell und theoretisch so zu erfassen, dass sich daraus ein besseres Verständnis der sich noch immer entfaltenden Umbruchsprozesse ergibt. Es zeigt sich, dass sich so etwas wie die »neuen« IB entwickelt haben.

Aufbauend auf den Arbeiten der Bremer und Berliner Sonderforschungsbereiche fragt der Band, was der Staat in Räumen konsolidierter und begrenzter Staatlichkeit zu effektiver und legitimer Governance beiträgt: Welche Governance-Leistungen erbringt er in den Politikfeldern Sicherheit, Gesundheit, Umwelt und Finanzmärkte? Welche Governance-Beiträge kommen von nicht-staatlichen Akteuren? Welche Beziehungs- und Konfliktmuster dominieren?
Der Band zeigt, erstens, dass der Staat in keinem der untersuchten Fälle das Governance-Monopol hält, sondern immer auch nicht-staatliche Akteure Governance-Funktionen ausüben. Zweitens finden wir ausgeprägte Unterschiede zwischen den Räumen: Während sich in Räumen konsolidierter Staatlichkeit tendenziell eine vom Staat moderierte Arbeitsteilung mit nicht-staatlichen Governance-Akteuren einstellt, ist das Verhältnis in Räumen begrenzter Staatlichkeit durch Konkurrenz und fehlende Hierarchie gekennzeichnet. Drittens unterscheidet sich das Zusammenspiel staatlicher und nicht-staatlicher Akteure kaum zwischen Politikfeldern.
Die Analyse mündet in der Unterscheidung von vier idealtypischen Governance-Konstellationen staatlicher und nicht-staatlicher Akteure.

Die Auseinandersetzungen um Stuttgart 21, Castortransporte, Schulreformen oder Rauchverbote zeigen eines: Das Bedürfnis der Bürgerinnen und Bürger nach politischer Mitsprache und Mitentscheidung ist in den letzten Jahren stark gestiegen. Gleichzeitig verlieren gewohnte politische Lösungskonzepte in einer zunehmend komplexen Welt an Wirkung, wodurch auch die klassische expertenbasierte Politikberatung immer mehr an ihre Grenzen stößt. Die Verfasser stellen den state of the art im Bereich der Politikberatungsforschung dar. Nach einer Einführung in das Themengebiet und einer Skizze der konzeptionellen und theoretischen Zugänge werden die inhaltliche Beratung (policy advice) und die Beratung, die den politischen Prozess betrifft (political consulting), skizziert. Für beide Spielarten der Politikberatung werden anhand eines beispielhaften Bereichs zentrale Akteure und Handlungsfelder identifiziert und mittels klassischer und aktueller Forschungsarbeiten sowie anderer Schlüsseltexte skizziert. Hinsichtlich des policy advice werden die Beratungsstrukturen der Exekutiven auf Bundes- und Länderebene sowie ausgewählte externe Beratungseinrichtungen berücksichtigt, für das political consulting die zunehmenden Angebote an kommerzieller Kommunikationsberatung ausgewählt. Ein Resümee skizziert auf dieser Basis die Gegenwart und Zukunft der Politikberatungsforschung anhand von Forschungskontroversen, Forschungs- und Wissenslücken sowie Forschungsdesideraten.
Welfare State Formation in the Enlarged European Union: Patterns of Reform in Postcommunist States

Eastern Enlargement of the European Union challenged the design of European Welfare states. Many authors discuss the impact of East European social security systems on their West European counterparts and fear a “race to the bottom”. This paper addresses welfare state developments in the eight post-socialist new member states which completed the accession process in 2004, Estonia, Latvia, Lithuania, Poland, the Czech Republic, Slovakia, Hungary, and Slovenia (EU-8). We focus on institutional patterns and performance as well as on the impact of internal and external actors of welfare state formation. How do the EU-8 diverge from West European welfare states and how do they fit into the typology of welfare state regimes?
