TY - BOOK A1 - Anheier, Helmut K. A1 - Hammack, David C. T1 - A Versatile American Institution: The Changing Ideals and Realities of Philanthropic Foundations N2 - America’s grantmaking foundations have grown rapidly over the course of recent decades, even in the face of financial and economic crises. Foundations have a great deal of freedom, enjoy widespread legitimacy, and wield considerable influence. In this book, David Hammack and Helmut Anheier follow up their edited volume, American Foundations, with a comprehensive historical account of what American foundations have done with that independence and power. While philanthropic foundations play important roles in other parts of the world, the U.S. sector stands out as exceptional. Nowhere else are they so numerous, prominent, or autonomous. What have been the main contributions of philanthropic foundations to American society? And what might the future hold for them? A Versatile American Institution considers foundations in a new way. Previous accounts typically focused narrowly on their organization, donors, and leaders, and their intentions—but not on the outcome of philanthropy. Rather than looking at foundations in a vacuum, Hammack and Anheier consider their roles and contributions in the context of their times and their economic and political circumstances. Detailed chapters from academics, practitioners and stakeholders bring diverse perspectives on a range of factors – from access rules to institutional design and to substantive functions – influencing the European Court’s political role. Each of the contributing authors invites the reader to approach the debate on the role of the Court in terms of a constantly evolving set of interactions between the EU judiciary, the European and national political spheres, as well as a multitude of other actors vested in competing legitimacy claims. The book questions the political role of the Court as much as it stresses the opportunities – and corresponding responsibilities – that the Court’s case law offers to independent observers, political institutions and civil society organisations. Judicial Activism at the European Court of Justice will appeal to researchers and graduate students as well as to EU and national officials. Y1 - 2013 SN - 9780857939395 PB - Elgar Publ. CY - Cheltenham [u.a.] ER - TY - JOUR A1 - Dawson, Mark A1 - De Witte, Floris T1 - Constitutional Balance in the European Union After the Euro Crisis JF - Modern Law Review N2 - This article analyses how the European Union's response to the euro-crisis has altered the constitutional balance upon which its stability is based. It argues that the stability and legitimacy of any political system requires the structural incorporation of individual and political self-determination. In the context of the EU, this requirement is met through the idea of constitutional balance, with ‘substantive’, ‘institutional’ and ‘spatial’ dimensions. Analysing reforms to EU law and institutional structure in the wake of the crisis – such as the establishment of the ESM, the growing influence of the European Council and the creation of a stand-alone Fiscal Compact – it is argued that recent reforms are likely to have a lasting impact on the ability of the EU to mediate conflicting interests in all three areas. By undermining its constitutional balance, the response to the crisis is likely to dampen the long-term stability and legitimacy of the EU project. This concept sees judicial review not as a check on majority preferences but instead as part of a deliberation between the legislative and judicial branches over how constitutional commitments and general political objectives can be integrated. This article will explore the prospects and limits of developing the dialogue concept in the context of the present-day European Union (EU). The article will present a two-part argument: While the EU's political and legal diversity make the idea of a 'shared responsibility' for constitutional interpretation between judges and policy-makers normatively attractive, the existing institutional structure of the Union limits the incentives necessary for legal and political actors to constitutionally engage. The article presents a typology of decision-making modes in economic policy-making in normal times and crisis times. It shows that problems of time-inconsistency in combination with high uncertainty over re-distributive implications lead to an “ad-hoc-technocratization” of economic policy-making. The separation of decision-taking from input-based legitimacy-procedures is relevant for scholars of democracy because the redistributive implications of crisis policies are high. The “democratic deficit” of crisis policies is thus not a symptom of “Post-Democracy” but of the specific context arising in an economic crisis. This volume addresses the question to what extent new forms of citizen participation enhance democratic legitimacy and where the limits are. N2 - Experiences from all around the world show that citizens increasingly articulate their discontent with large-scale projects. Still, public debates often leave politics, administrations, corporations and citizens unsatisfied. How can we improve mutual understanding, provide political legitimacy and facilitate economic efficiency? This book pinpoints the opportunities and challenges of participatory modes of governance by offering theoretical accounts and analyses of large-scale projects focusing on infrastructure, communication and public administration.
