In Germany, policies grant refugees different levels of labor market access according to legal status, a hierarchical system also referred to as differential inclusion. This study compares perceptions and experiences of these labor market policies and discourses among refugees with four legal statuses. Refugees with the most precarious legal status are largely barred from the labor market, leading them to experience severe exclusion and pushing them into liminal spaces of existence. While recognized refugees may be able to work, racialized discourses about their deservingness create conditional and limited senses of belonging. Finally, refugees often themselves observe these hierarchies, reinforcing feelings of exclusion. Results demonstrate how the hierarchies present in policies create a stratified system of differential non-belonging. Overall, the article sheds light on how differential inclusion of refugees also results in hierarchized experiences of differential (non-)belonging. We vow to listen to them, and we want to work together to shape the future of the European Union”, stated European Commission President Ursula von der Leyen during the celebrations of the 2022 European Year of Youth. Nevertheless, young generations today are underrepresented in European institutions and their interests risk being sidelined. For this reason, we advocate the introduction of youth quotas in the European Parliament. These should take the form of legislated candidate quotas. Our aim is to increase the number of young adults elected to match more closely the share of under-35 in Europe. Only in this way can we ensure that the distinct concerns of younger generations are being adequately heard and discussed in the decision-making arena. Examining a range of countries over time, it is found that their policy choices and subsequent performance are too varied to support the inevitable, almost mechanical, incompatibility the Quandary implies. While balancing the relationship between economic globalization, social cohesion, and democracy continues to be a major challenge for developed market economies, results show they are not helpless in what Dahrendorf feared to be a Herculean task of “squaring the circle” among incompatible trends. The emergence of phenomena like fake news and hate speech has shown that political discourse on micro-blogging can become strongly polarised by algorithmic enforcement of selective perception. Recent findings suggest that some political actors might employ strategies to actively facilitate polarisation on Twitter. With a network approach, we examine the case of the German far-right party Alternative für Deutschland (AfD) and their potential use of a “hashjacking” strategy (The use of someone else’s hashtag in order to promote one’s own social media agenda.). Our findings suggest that right-wing politicians (and their supporters/retweeters) actively and effectively polarise the discourse not just by using their own party hashtags, but also by “hashjacking” the political party hashtags of other established parties. The results underline the necessity to understand the success of right-wing parties, online and in elections, not entirely as a result of external effects (e.g. migration), but as a direct consequence of their digital political communication strategy. Rudolf Bernhardt Lecture, 2020 JF - Zeitschrift für ausländisches öffentliches Recht und Völkerrecht / Heidelberg Journal of International Law N2 - This article undertakes a survey of the changes in the structure of the interpretive doctrines of the European Court of Human Rights (the Court) over time in an exploration of the aging of the European Convention on Human Rights (ECHR or the Convention) on its 70th anniversary. It argues that the Court’s interpretive doctrines that seek to give due defer ence to national rights traditions, canons and institutions have become increasingly pervasive in the Court’s procedural and substantive case law in the last two decades. This, in particular, has come at a loss for interpretative doctrines that interpret the Convention as a practical and effective living pan-European instrument. This argument is built in four parts. First it offers a defence of why a study of the interpretive doctrines of the Court over time is a good proxy for studying the ECHR’s ageing process. In the second part, it discusses the rich doctrinal forms of due deference and effective interpretation in the case law of the Court – both young and mature. Part three explains how the judicialisation and expansion of the European human rights system in late 1990 s transitioned to a more height ened and sophisticated focus on due deference doctrines in the Court’s case law. Finally, part four examines whether the recent judicial innovations under the Court’s Article 18 case law and the widely celebrated success of increased ownership of the Convention by domestic courts can act as counter points to the argument that the effective interpretation principle has suffered a loss as the Convention has aged, concluding that none of this may offset the fact that the Convention at 70 is more conservative in spirit than its younger self. But does this veneer of success mask deeper structural issues? This report finds that, despite strong measures of GDP per capita and state capacity, Australia has long struggled to move its economy past a reliance on commodity exports—notably to China. At the same time, its democratic innovations such as compulsory electoral participation, early adoption of women’s suffrage, and preferential voting conceal a darker history of indigenous dispossession and racial discrimination. To move past these problems, Australia will have to leverage its impressive state capacity and strong educational system to develop a more advanced services sector and foster more complex manufacturing. Given the necessity of innovation clusters in its already-productive cities, this will also require addressing the severe housing crisis in state capitals and encouraging more migration and acceptance of minorities. Only with a more complex economy can Australia ensure future growth and reduce vulnerability to foreign powers like China and the US. Jahrzehntelang dominierten die einander ausschließenden Ideologien Kapitalismus und Kommunismus die weltpolitische Bühne, bis der Mauerfall (zumindest letztere) zum Einsturz brachte. Kurzum: Große Erzählungen sind in den unterschiedlichsten Kontexten Antreiber von Veränderung und ideologischer Bindung gewesen. Um diese »Narrative« geht es im Folgenden. Vom lateinischen narrare (erzählen) abgeleitet, gilt die Erzählung, idealerweise die überzeugende Erzählung, als Lösung für das Problem des Auseinanderdriftens unserer Gesellschaft. Der Begriff hat sich in den Nullerjahren vom politikwissenschaftlichen Elfenbeinturm in die Leitartikel geschlichen. To that end, we combine data from published trial heat polls with structural information. The model takes care of the multi-party nature of the setting and allows making statements about the probability of certain events, such as the plurality of votes for a party or the majority for coalition options in parliament. The forecasts of our model are continuously being updated on the platform zweitstimme.org. The value of our approach goes beyond the realms of academia: We equip journalists, political pundits, and ordinary citizens with information that can help make sense of the parties’ latent support and ultimately make voting decisions better informed.
