The emphasis for the preventive arm rests on the monitoring of Member State behaviour. Euro-area Member States produce Stability Programme updates yearly in the autumn. The au-thors consider how current developments address two key policy concerns: an emphasis on high skills as a means of achieving economic competitiveness and raising productivity; and the promise of increasing access for students hitherto excluded from higher education. We address these questions in relation to specific country contexts, in order to highlight similarities and differences in developments within the European arena and in a wider global context. We locate our analyses in an understanding of the different political and socio-economic conditions within different countries, which render particular reforms and innovations both possible and realiza-ble in one context, but almost unthinkable in another. We argue for the need to recognize and embrace diversity in provision, while using comparison across countries as a means of chal-lenging taken-for-granted assumptions of how things are and what is possible within individual country contexts. However, due to the growing demand for abstract and codified knowledge, all three countries aim at increasing the permeability and individual mobility between the dual training sector and the higher education system. In this chapter we analyse the ways in which Germany, Austria and Switzerland have tried to establish institutional linkages between dual vocational training and higher education. We begin by discussing options for creating such linkages: (1.) upgrading of vocational education and training courses, (2.) introducing dual courses of study, (3.) facilitating attendance of general upper secondary schools for people with vocational qualifications, (4.) enabling the parallel acquisition of a dual vocational training qualification and a higher education entrance qualification, (5.) allowing admission to higher education on the basis of prior dual vocational training qualifications and a certain amount of work experience, and (6.) recognising prior learning as an element in higher education programmes. Our analysis shows that, recently, Germany has relied strongly on the admission to higher education based on vocational training certificates in combination with work experience. Switzerland and Austria are rather pushing the comprehensive introduction of programmes that enable the parallel acquisition of a dual vocational training qualification and a higher education entrance qualification. With contributions from leading academics, this book is the first to provide a comprehensive analysis of the varying historical origins of, and recent developments in, vocational training systems, offering in-depth studies on coordinated market economies, namely Germany, Austria, Switzerland, the Netherlands, and Denmark. It also contains comparative chapters that analyse how these countries react to common challenges such as deindustrialization, labour market stratification, academic drift, gender inequalities, and Europeanization. Whereas previous research has focused on the differences between various kinds of skill regimes, this book focuses on explaining institutional variety within the group of collective skill formation systems. This volume engages critically and constructively with this question to provide a distinct contribution to the contemporary discussion on human rights. Fassbender and Traisbach, along with a group of leading experts in the field, examine the issue from multiple disciplinary perspectives, analysing the limits of our current discourse of human rights. It does so in an original way, and without attempting to deconstruct, or deny, human rights. Each contribution is supplemented by an engaging comment which furthers this important discussion. This combination of perspectives paves the way for further thought for scholars, practitioners, students, and the wider public. Ultimately, this volume provides an exceptionally rich spectrum of viewpoints and arguments across disciplines to offer fresh insights into human rights and its limitations.}, language = {en} } @incollection{Anheier, author = {Anheier, Helmut K.}, title = {The Future Role of Civil Society in a Welfare State: Perspectives from Germany}, series = {Globalizing Welfare: An Evolving Asian-European Dialogue}, booktitle = {Globalizing Welfare: An Evolving Asian-European Dialogue}, editor = {Kuhnle, Stein and Selle, Per and Hort, Sven E. This is particularly influential where rapid social development is taking place amidst growing social and gender inequality. This book reflects on the growing academic and political interest in global social policy and ‘globalizing welfare’, and pays particular attention to developments in Northern European and North-East Asian countries.Providing historical and future-oriented perspectives on welfare issues and policies, Globalizing Welfare assesses the relevance of the Northern European welfare experience for East Asia, and addresses the differing ways that countries in the two regions are responding to similar challenges of increasing inequality, demographic change, and shifting relations between the state, market and non-profit organizations. With topical analysis of policy responses to these shared issues across contexts, the book assesses how these globalized, cross-cutting issues will impact future developments in welfare states. This book is a valuable resource for scholars and students alike of sociology, political science, economics, social policy and public administration, providing up-to-date knowledge of welfare state developments. The dominant way of seeing social enterprises as pursuing dual - commercial and social - goals and as ideal sites to study the battle of logics confines our way of looking and limit the theorizing potential around social enterprise. In this chapter I advocate for disciplined exploration approach to study social enterprises to expose this potential. Trajectorism is a deeper epistemological and ontological habit that always assumes there is a cumulative journey from here to there, or more exactly from now to then, in human affairs. The chapter argues that trajectorism is the great narrative trap of the west and is also, like all great myths, the secret of its successes in industry, empire and world conquest. One must recognize that contrary to the dominant meta-narrative of western modernity, it is not itself a cumulative, predictable or inevitable outcome of any discernable history. This meta-narrative is itself an expression of a trajectorist ideology, which tends to see Europe itself as a logical outcome of ideas that led from one phase or idea to the next, in some sort of destined manner. One consistent finding of the literature is that women and men are affected differently by divorce and separation. Women, and particularly mothers, are likely to suffer from a loss of income. Fathers frequently suffer from having reduced contact with their children, who usually continue to live with their mother after a union dissolution. This chapter uses 10 years of data from the German Family Panel (pairfam) to examine more closely the gender differences in life satisfaction after separation. In line with previous research, we show that following a separation, satisfaction with family life declines more among fathers than among mothers, and that mothers tend to experience a greater decline in their satisfaction with their financial situation than fathers. We also examine the role of shared parenting (Wechselmodell) in parents' life satisfaction. Our findings indicate that shared parenting is positively associated with well-being, but also that the association is not stable to the inclusion of socio-economic characteristics that explain the selection into shared parenting. Civil society actors are embracing digital tools and using them for advocacy and citizen mobilisation. The chapter first distills pertinent international human rights law (IHRL) on migration-related detention, and then examines IOM's normative statements concerning detention. It shows that while IOM generally emphasises international legal standards, it also tends to stress states' 'prerogative' to detain, frame alternatives to detention (ATDs) as a desirable option rather than a legal obligation, and weave an operational role for itself, notably through assisted voluntary returns (AVRs). The chapter then interrogates IOM's involvement in detention through four case studies. These reveal not only IOM's changing role regarding detention, but its enduring part in a global system whereby powerful states and regions seek to contain protection seekers 'elsewhere.' The chapter concludes that, without constitutional and institutional change to ensure it meets its positive human rights obligations, and deeper critical reflection on its humanitarian duties, IOM's practice risks expanding and legitimating detention.}, language = {en} } @incollection{ZieglerVolou, author = {Ziegler, Katja S. and Volou, Aristi}, title = {Human rights and general principles: beyond the EU Charter of Fundamental Rights}, series = {Research Handbook on General Principles in EU Law}, booktitle = {Research Handbook on General Principles in EU Law}, editor = {Ziegler, Katja S. and Neuvonen, P{\"a}ivi J. and Moreno-Lax, Violeta}, publisher = {Edward Elgar Publishing}, isbn = {9781784712389}, doi = {10.4337/9781784712389.00027}, publisher = {Hertie School}, pages = {327 -- 349}, abstract = {This chapter discusses the dialectic relationship of general principles and the evolution of human rights in the EU legal order.
