Yet, at the same time, the world seems alive with a cacophony of approaches-old and new-on how to improve governance and, ultimately, policy outcomes. This collection-the first in a series of annual editions-seeks to address the implications of the current state of the world in terms of "good governance", i.e. the effective, efficient, and reliable set of legitimate institutions and actors dedicated to dealing with matters of public concern, be it in the field of financial markets (the focus of this edition), health care, security, or migration, and across local, national and international levels. Researchers at The Hertie School of Governance (Berlin, Germany) and other experts examine the current state of governance challenges and innovations from a variety of inter-disciplinary perspectives. This edition features a special set of chapters on the challenges of financial and fiscal governance, the tradeoffs faced by governance actors, and the new arrangements that have emerged or are required to not only address the ongoing crisis but also ensure greater stability into the future. This special section is complemented by chapters introducing basic concepts and models; exploring other global challenges and the reasons behind seemingly lackluster responses to them and highlighting the need for responsible sovereignty; conceptualizing governance innovation and introducing key examples; and assessing existing indicators of governance, while proposing a new framework for collecting, interpreting and applying governance-related information}, language = {en} } @incollection{Joerges, author = {Joerges, Christian}, title = {Is There a Guardian of Constitutionalism in the European Union?}, series = {The Future of Europe: Democracy, Legitimacy and Justice After the Euro Crisis}, booktitle = {The Future of Europe: Democracy, Legitimacy and Justice After the Euro Crisis}, publisher = {Rowman \& Littlefield International}, address = {London}, isbn = {978-1783481132}, language = {en} } @incollection{JoergesGlinski, author = {Joerges, Christian and Glinski, Carola}, title = {European unity in diversity?!: A conflicts-law re-construction of controversial current developments}, series = {Varieties of European Economic Law and Regulation: Liber Amicorum for Hans Micklitz}, booktitle = {Varieties of European Economic Law and Regulation: Liber Amicorum for Hans Micklitz}, publisher = {Springer}, address = {Berlin [u.a.]}, isbn = {978-3-319-04902-1}, pages = {285 -- 314}, abstract = {The EU has come a long way since its foundation as the European Economic Community in 1957. Starting out as a purely economic union, the integration process has progressively entered into areas of political, social and cultural concern for the Member States. Meanwhile, the institutionalised 'logic of the market' and related harmonisation increasingly lead to tensions not only with varying socio-economic and legal systems, but also with different political and cultural perceptions. 'Conflicts-law constitutionalism' aims at developing new awareness for Europe's conflict constellations and their (re-)interpretation with respect to socio-economic diversity, the social embeddedness of markets and the different regulatory cultures in the Member States. Therefore, it does not only serve for critical re-construction of the integration process but also aims at a 'third way' between the defence of the nation state and a quasi-federalist streamlining of Europe`s diversity. This is illustrated with five prominent and topical conflicts where market interests interfere with political, social and cultural preferences: the legendary Cassis de Dijon case, the labour law cases of Viking and Laval, the fully harmonised unfair commercial practices law, the promotion of renewable energies and the regulation of genetically-modified organisms. As changes take shape, governments are challenged to explore new reforms. The public sector is now characterized by profound transformation across the globe, with ramifications that are yet to be interpreted. To convert this transformation into an ongoing state of improvement, policymakers and civil service leaders must learn to implement and evaluate change. This book is an important contribution to that end. Reforming the Public Sector presents comparative perspectives of government reform and innovation, discussing three decades of reform in public sector strategic management across nations. The contributors examine specific reform-related issues including the uses and abuses of public sector transparency, the This volume will greatly aid practitioners and policymakers to better understand the principles underpinning ongoing reforms in the public sector. Giovanni Tria, Giovanni Valotti, and their cohorts offer a scientific understanding of the main issues at stake in this arduous process. A European Investment Bank (2007) report clearly shows that the UK is still a forerunner in terms of both number of PPP projects and volume. Out of a cumulative value of €194.7 billion that has been signed up until the end of 2006, the UK accounts for 57.7 per cent. However, it is also clear that the UK market is maturing (e.g. Ysa, 2007), whereas the rest of the European PPP market is growing. International organizations such as the World Bank, the OECD and the International Monetary Fund, together with multinational professional companies (e.g. PwC, 2005; Deloitte, 2006a, 2006b; DLA Piper, 2007; Ernst \& Young, 2008), played an important role in the international diffusion of PPPs both as promoters and as knowledge carriers. Within Europe especially, the European Commission has given a strong impetus in a similar form when launching a Green Paper on PPPs in 2004 (European Commission, 2004). PPPs have raised high expectations among scholars, governments and practitioners in Europe alike. They are seen as 'a new generation of management reforms' (Pollitt, 2003, p. 53) and have found their way into many government programmes throughout Europe.
