We argue that pessimistic views on the creation of EMU have proved to be wrong. Yet EMU's success is rather puzzling, since it is based on a peculiar institutional structure not thought to lead to success. EMU has generated redistributive effects and may have increased business-cycle synchronization. Those effects have not translated into the expected decrease of legitimacy or a widespread democratic deficit of EMU. At the institutional level, EMU has coped well with an asymmetric framework, largely decoupling EMU from political union. There have been neither major spill-over effects pushing for further political integration nor conflict and disintegration. Zugleich hat Deutschland auch immer wieder pragmatisch gehandelt, um die Eurozone zu erhalten. So war das Land maßgeblich an der Schaffung des Europ{\"a}ischen Stabilit{\"a}tsmechanismus und dem Aufbau einer Bankenunion beteiligt und tolerierte eine Reihe von außergew{\"o}hnlichen Maßnahmen der EZB. Trotz der Reformbem{\"u}hungen der letzten Jahre weist die Eurozone weiterhin Konstruktionsfehler auf, die die Stabilit{\"a}t der gemeinsamen W{\"a}hrung ernsthaft gef{\"a}hrden. This paper shows that this is no longer the case. Building a dataset covering four decades, we find that creditor lawsuits have become an increasingly common feature of sovereign debt markets. The legal developments have strengthened the hands of creditors and raised the cost of default for debtors. We show that legal disputes in the US and the UK disrupt government access to international capital markets, as foreign courts can impose a financial embargo on sovereigns. The findings are consistent with theoretical models with creditor sanctions and suggest that sovereign debt is becoming more enforceable. We discuss how the threat of litigation affects debt management, government willingness to pay, and the resolution of debt crises.}, language = {en} }
