Using Scharpf's 'input' and 'output' legitimacy concepts, it is argued in this article that its design does worsen the democratic deficit. There are good reasons to limit 'input legitimacy' for politically independent institutions. 'Output legitimacy' is then even more relevant. Transparency is a key part of 'output legitimacy'. It enables actors to judge whether the regulator is acting in the public's interest and can improve their outputs. This article focuses on the banking data that the supervisors collect. Data available to the European public is evaluated and compared to America's banking union. European practices are not comparable in terms of availability or detail. An original survey of relevant officials is conducted, which results in the finding that only 11 of 28 Member States release any information on the banks they supervise. Our contribution is the examination of how federalism can affect decisions to classify banks as systemically important. Whether a bank is viewed by politicians as 'systemically important' varies based on how its failure would affect supporters of the government. How a federation is designed has a strong influence on which banks are given public assistance. Where the top level of government is solely responsible for banks, there will be fewer systemically important institutions and so more banks will be allowed to fail. Where lower levels are responsible, governments will allow fewer failures. We use this approach to understand government support for failing banks in Germany. We argue that pessimistic views on the creation of EMU have proved to be wrong. Yet EMU's success is rather puzzling, since it is based on a peculiar institutional structure not thought to lead to success. EMU has generated redistributive effects and may have increased business-cycle synchronization. Those effects have not translated into the expected decrease of legitimacy or a widespread democratic deficit of EMU. At the institutional level, EMU has coped well with an asymmetric framework, largely decoupling EMU from political union. There have been neither major spill-over effects pushing for further political integration nor conflict and disintegration. What is more, the notion of trust has become a central issue in current social science theorizing covering such diverse approaches as transaction costs economics or cognitive sociology. In different ways and for different purposes, these approaches address the role of voluntary organizations, although, as this paper argues, much of this thinking remains sketchy and underdeveloped. Against an empirical portrait of this relationship, the purpose of this paper is to assess such theorizing. We first set out to explicate major approaches to trust in economics, sociology and political science, using the non-profit or voluntary organization as a focal point. We then examine the various approaches in terms of their strengths and weaknesses, and, finally, identify key areas for theoretical development. One view sees the third sector in East Germany as an expression of civil society, rooted in an emerging democratic culture, and based on a broadening social participation. According to the other view, the East German third sector is largely an extension of West German organisations that, in the process of "peaceful colonisation," created "organisational shells" without a corresponding "embeddedness" in local society. The paper suggests that the way the policy of subsidiarity has been implemented in Germany may help account for such competing interpretations: subsidiarity has created tendencies toward a bipartite third sector, with each part differing in size, scope and financial structure. One part is relatively well funded and state-supported, the other characterized by small organisations and membership orientation. The unification process has amplified these tendencies, which, in the context of public austerity budgets, are having repercussions on the system of financing non-profit organisations as a whole. This growth has disproportionately been an expansion of the economic dimensions (employment, turnover) and basically involved the greater use of third sector organisations as service providers. Such provision uses complex contract regimes, and typically takes place in some form of public-private partnership with either public or private funding agencies. Other parts of the third sector such as membership, volunteering and giving have generally grown less. The paper suggests that the sector is becoming qualitatively different, although the nature and strength of this change depends on the nonprofit regime type in a given country. Generally, however, third sector growth has led to differentiation processes that involve new organisational forms, and changes in activities and overall composition. The paper explores the measurement aspects of the quantitative-qualitative jump in third sector development by trying to "map" changes in core facts or dimensions over time.
