Modern law and local tradition in forest heritage conservation in Cameroon : the case of Korup

Cameroon’s forests are exceptionally rich in biodiversity but are among the most threatened forests in the Congo Basin. To safeguard the country’s forest heritage, the government resorted to the creation of protected areas such as the Korup National Park (KNP) but ignored the local traditional system of natural resource management and relied merely on modern law for its protection. But the protection of the park only through modern law has not yielded satisfactory results since it still faces numerous problems which exacerbate biodiversity loss. With many problems facing the park, there is growing concern with regards to government strategy to maintain its values and integrity merely through modern law. This dissertation aims at assessing the potentials of modern law and local traditional system of natural resource management as instruments for effective protection of the KNP in particular and other Cameroonian national parks in general. It further aims at exploring ways of adapting national law and policy to suit local reality. To realise the objectives of this study, legal science analytical method, instruments of both quantitative approach (questionnaire) and qualitative approach (semi-structured interviews) were used. An in-depth assessment of the degree of effectiveness of modern law application in Korup reveals that it is to a lesser extent effective and this impedes Cameroon’s adequate compliance with its biodiversity conservation obligations under international environmental agreements. The study finds that the park’s protection unit plays a commendable role in fighting against illegal activities but inadequate financial resources and logistics render the institution weak. Other institutions play a laudable role in enforcing the law but major weaknesses identified include bail abuses, leniency in punishing offenders and corruption. It was discovered that the Korup inhabitants are against resettlement and often reluctantly cooperate in enforcing modern law. The research reveals that cultural beliefs and traditional practices associated with totems, taboos and sacred forests exist in the Korup villages and contributed in protecting Korup forest heritage. It shows that the putting into practice of some aspects of the traditional cultural practices was often without conservation intention but paradoxically, this contributed to forest biodiversity conservation. The study finds that each village has customary laws and local bylaws which are binding on its inhabitants and contribute to rational use of forest resources. The chieftaincy, village council and the Ekpe society are revealed as traditional institutions that govern the Korup people and manage forest resources through the traditional system ignored by the state. The research shows that statutory law recognises only the chieftaincy institution but reduces traditional rulers to mere auxiliaries of the government thereby weakening traditional institutions that ought to contribute in protecting Korup forest heritage. It recommends that in addition to fighting corruption and building the capacity of law enforcement institutions, the government should adequately integrate traditional rulers and institutions into the modern governance structure. It should legally recognise the role of traditional authorities in safeguarding Korup forest heritage through the traditional system. The study concludes that a management and conservation strategy that involves the people of Korup through their traditional institutions and system of natural resource management, will lead to effective protection and sustainability of the KNP and thus, contribute in enhancing Cameroon’s compliance with biodiversity-related international environmental agreements.
Possible synergy between FLEGT-VPA & REDD+ towards improving forest governance framework in Cameroon

Illegal logging is seen as a serious impediment to achieving sustainable management of forests in the tropics. In addition, deforestation contributes in increasing carbon dioxide emissions in the atmosphere, resulting to biodiversity loss and climate change. Illegal logging and deforestation have affected Cameroon’s forest ecosystem negatively since the mid-1980s as a result of the economic crises, which intensified the exploitation of forest resources for multiple purposes. In response, some policy initiatives came up such as FLEGT-VPA and REDD+ to fight against the threats. It is due to the above background that this study was designed to examine the possible synergy between FLEGT-VPA and REDD+ towards improving the forest governance framework in Cameroon. The first part of the study assesses FLEGT-VPA in Cameroon with the application of interviews of key informants who were involved in the negotiation process of the EU-Cameroon Voluntary Partnership Agreement. The second part of the study assesses the management of Bimbia Bonadikombo Community Forest (BBCF), as one of the REDD+ pilot project sites around Mount Cameroon in the South West Region of Cameroon. The use of surveys, content analysis, and observations seeks to assess these two initiatives in their role in improving forest governance in Cameroon. The first part of the research reveals that since Cameroon ratified the FLEGT-VPA in 2011, there has been progressed concerning stakeholder participation in forest-related issues. Again, the study also reveals challenges faced with the setting up of a system to verify timber from legal origin as recommended by the European Union. The research further reveals a lack of commitment by the government in revising the current forest policies and re-organizing the domestic market for timber trade as part of the commitment made by the government during the ratification of the FLEGT-VPA. The second part of the study finds that the management of BBCF is not governed by the provision of the Cameroon community forestry manual or by its bylaws posing doubts if community forestry can halt emissions of greenhouse gases caused by deforestation, thus helping REDD+ achieve its objectives. The study recommends the need for rapid policy reform and a cross-sectoral transformation to enable FLEGT-VPA and REDD+ to synergize for a better policy outcome on issues concerning forestry and climate change.
Reducing Emissions from Deforestation and Forest Degradation (REDD+) is now a significant piece of the international climate agreement. This present dissertation aims to investigate the overall framework of REDD+ development as a national strategy in Brazil. Moreover, it focuses on identifying the major challenges and policy constraints of this development design process. A further aim is at the end of the research to proffer pathways for improvement of domestic forest governance in Brazil. Using the sustainable forest landscape governance approach as the overarching conceptual for an effective REDD+ implementation within the Brazilian context and, building on this analysis, the conclusions advance some considerations on what features should be prioritized in the development and establishment of the Brazilian REDD+ national strategy. This dissertation is a grounded theoretical analysis and is centered on the conception that although REDD+ is strongly treated by the Federal Government as an expansion of it’s actions with regard to sustainable development, by turning forests into an economic asset and strengthening institutions and laws, it is much more likely that Brazil can deal with the environmental challenges it has been facing.
Cameroon’s forest is one of the richest ecosystems in the Congo Basin and in Africa as a whole in terms of its biodiversity. These forest types are currently subjected to multiple categories of threats. By enacting a new forestry law in 1994, the government of Cameroon intended to intensify efforts toward the protection and conservation of this rich biodiversity. This study aimed to compare two forest management systems, a state management system (the case of Takamanda National Park) and a community-based management system (the case of Bimbia- Bonadikombo Community Forest), to determine which management system better conserves and protects the forest against biodiversity loss. The study applied a methodological framework that made use of selected indicators and criteria to evaluate the extent of sustainability of the two forest management systems and challenges faced in implementing them. Both quantitative and qualitative results were realized through the administration of questionnaires, semi-structure interview and in-depth contents analysis of Law No.94-1 of 20th January 1994 that lays down forestry, wildlife and fisheries regulations and the 1996 Environmental Management Law that directs Cameroon’s compliance to the international standard of protecting the environment.Results indicated that community-based system of forest management is a much more sustainable approach of forest management than a state management system. Based on the criterion of cultural values attributed to natural resources in the community-based management zone (Bimbia- Bonadikombo Community Forest), 78.2% of the local communities were more willing to protect biodiversity as opposed to 48.3% from state management zone (Takamanda National Park). This study found that the level of participation in the community-based management system was much more inclusive and transparent. On the other hand, in the state management system, a high level of corruption, lack of transparency, delayed and irregular salaries of forest guards and minimal participation of local communities in forest management decision-making was noted and likely responsible for the ineffectiveness and unsustainable management efforts in this system. The study recommends the adoption and implementation of a more inclusive, transparent and accountable management in the state managed system (Takamada national park), particularly the full involvement of respected Elites, Chiefs and Traditional Councils.
Tanzania is the land which has extensive Limestone Caves along the Swahili Coast of East Africa. Many of these Limestone Caves believed to be formed about 150 million years ago during the Jurassic age when these areas were underwater. For a long time, Swahili communities along the coast of East Africa used the Limestone Caves as the places of worship, praying and conducting ritual practices. These Limestone Caves have been regarded as the Mosques, Churches or Temples by these Swahili communities who have been associated with the Caves for a long time before colonial time in 17th-19th Century. After independence in 1961, the Tanzanian government took over many of the Limestone Caves to manage and protect them as the national heritage under the Antiquities Divisions and other heritage governing bodies. However, in Tanzania the protection of Limestone Caves as Sacred Heritage Places have been only through modern laws which were inherited from colonial masters and are yet to produce satisfactory results on the best practice of these places, even after amendments. Other problems facing Sacred Heritage Places in Tanzania are lack of management plans, lack of freedom in worship and failure of Antiquities legislation to recognise traditional beliefs. These problems led to growing concern of different stakeholders regarding the government strategy to ensure prescriptions for best practices of the Sacred Heritage Places in Limestone Cave areas regarding the use, management and conservation.
Therefore, the purpose of this thesis is to examine the use and management of Sacred Heritage Places along the Swahili Coast of the Indian Ocean in Tanzania. Data were obtained through focus group discussions, interviews and observations while legal documents were reviewed and analysed using thematic analysis to investigate research themes. The results indicated that there were ritual practices, strict taboos and customary laws used to control access into the Limestone Cave area but tourism and research activities have interfered with the sacred space creating a disconnect between the local communities and their heritage. This disconnection has driven people from their traditional religions into religions like Christianity and Islam.
Finally, the thesis proposes MTRCC Framework for a heritage plan for best practice in Sacred Heritage Place in Limestone Cave areas; to be adopted by the Tanzanian Antiquities Divisions and other heritage management authorities to ensure that local communities have access to spaces crucial to their religious life. Also, MTRCC Framework ensures that there are no conflicts or
interference from tourism, education and research activities that could result in negative effects for the heritage sites and stakeholders can have equal opportunities to experience these places.
Large mammals constitute an integral part of biological resources, and hence fundamental elements in many ecosystems. In view of the roles played by habitats and humans in structuring large mammal populations, research was conducted in the Deng Deng National Park, with the aim to identify and characterize the spatial and temporal patterns of habitats, determine the relationship between habitat heterogeneity and mammal abundance and also to investigate the types and extent of human pressure on various large mammal species in the park.
Distance sampling technique and kilometric index analyses approaches were applied to determine species presence, frequency and abundance, with dung, nests, and tracks used as proxy for species presence. Using a spatio-temporal analysis approach in Geographic Information System, species distribution was analyzed. Small and medium sized duikers, red river hog and gorilla were most frequently encountered. Important is the record of elephant for the first time in the park, emphasizing the importance of the park for large mammal conservation.
Diverse land cover types that constitute habitats for flora and fauna were distinguished and characterized as dense forest, mature secondary forest, young secondary forest, tree and grassland savanna, settlement and degraded areas, and water bodies. Area, mean patch size, shape, density and richness metrics of these land cover types varied, emphasizing the heterogeneity of the park landscape. No significant differences (0.2 ≤ p ≥ 0.8) were observed in species abundance due to diverse habitat characteristics in the park. Species exhibited generalist habits with preference mostly for the dense and mature secondary forest habitat types. Temporal pattern over a 23 years’ time lag projected a 6.19 % increase in dense forest cover, suggesting future shelter opportunities for large mammals in the park.
The park is experiencing threats that are changing the physical environment in simple and reversible manner but also threats that have changed the parks environment in permanent ways; all from impacts of adjacent human settlements and development activities. Generally, species abundance was significantly high (p = 0.03) in habitats where threats encounter rates were low, and low in habitats affected by high human activity; a clear indication that these activities have eventually created depressing effects on the habitats of large mammal species in the park.
Actions aimed to limit human activities around the park, and aiming to sustain the large mammals and their habitats, especially within the hotspots identified in this study, are therefore proposed to ensure a more sustainable future for large mammals in the Deng Deng National Park.
Thermal recycling of plastic waste using pyrolysis-gasification process for energy production

The disposal of mixed waste in landfills, dump sites and open burning without material and energy recovery leads to resource loss, causes health problems, pollution and littering. Increasing energy demand for industrial and domestic application with rising costs due to scarcity motivates a constant search for alternative clean energy sources. Recovering energy from waste presents various incentives e.g. creating jobs, alleviating poverty, combating and mitigating climate change, protecting the environment and reducing dependence on traditional fuels sources. Hence, plastics end up in landfills, surface waters and ocean bed with serious negative impact on terrestrial and aquatic biodiversity. Plastic waste with high calorific value (36-46MJ/kg) occupies the greatest portion of landfill space. Hence, using an appropriate technology to transform waste plastic to a hot gaseous mixture which is burned in-situ produces enormous amount of energy without pollution. Based on this hypothesis, the study objectives accomplished were to: 1.Characterise, quantify and classify waste fractions and plastic components common in MSW by manual sorting 2.Evaluate options for sustainable plastic waste management especially for developing countries 3.Design, construct, test and optimize an appropriate technology that applies pyrolysis and gasification processes to convert non-PVC plastic waste to energy 4.Assess the efficiency of the technology based on the functioning, the engineering, mass and energy analysis including socioeconomic and environmental impacts An integrated methodology involving review of current literature, field and laboratory experiments on mixed waste and plastic waste analysis was used. In addition, the pyrolysis-gasification technology (PGT) was conceptualised, designed, constructed, tested and optimised at BTU Cottbus, Germany; Lagos, Nigeria and Dschang, Cameroon. Field studies involving natural observation, interviews, personal discussions and visits to waste management organisations and disposal sites were conducted in various cities in the three case study countries. A resource-oriented manual sorting using the resource-recovery scavenging approach (RESA) simulating integration of scavenger’s activities in waste sorting was conducted at BTU and Lagos. Major results obtained include: •Characterization, quantification and classification of a dry sample of commingled MSW at Cottbus gave major waste fractions in order of decreasing abundance as 23.15% of residue waste, 19.75% of paper and cardboards, 17.80% of plastics, 14.63% of textiles and diapers, 10.06% of food waste and 9.55% of glass. An overall 33.21% of waste sample is compostable for manure, 52.2% usable as feedstock in the PG technology and 99.81% of total sample having a material or energy recovery potential. In Lagos, Nigeria main fractions were 29% of plastics, 36% of residue waste, 17% of soil/sand, 7% of paper with overall 41% usable as feedstock in PG technology, 39% compostable, 3% of recyclable (metal and glass). Sand can be recovered from the soil/sand fraction for construction. Excluding the sand/soil mixture, 83% of the total waste sample has potential for material and energy value. •An appropriate technology that applies principles of pyrolysis and gasification to convert non-PVC plastic waste to energy was designed, constructed, tested and optimized with respect to: (i) Successful functioning with conversion of averagely 98.51% of input constituting of 82.78-98.21% of charcoal and 96.72-99.27% of plastic to heat energy (ii) Evaluation of socioeconomic and environmental impacts based on pyrolysis and exhaust gas and ash residue analysis showed absence of VOCs, heavy metals and pollutant organic and inorganic compounds; (iii) Safety and risk assessment to indoor pollution is very low; (iv) Assessment of the WTA and WTP indicated that 94% of respondents in Lagos, Nigeria and Porto Novo, Benin were willing to accept and pay for this technology. Using the PG technology improves local communities’ ability to achieve clean, efficient and safe cooking and heating energy with potential for combine heat power generation.
Forest resources provide a means of livelihoods in rural communities in most developing countries. Growing threats of disappearance of these resources as a result of human and natural activities led Cameroon in 1994 to institute new forest policy reforms which amongst others aimed to formalize and strengthen the involvement of local communities in forest management. Although much has been written on the importance and methods of participation of the local people in sustainable forest management, little has been done to assess the involvement of especially women in forest management activities. This study aims to contribute to an understanding of the roles of indigenous men and women in forest management activities, how they are shaped by management regimes and the influence on their livelihoods.
Results are based on empirical findings from two case studies-the Korup National Park Area (KNPA) and Bechati Forest Area (BFA). The analysis focuses on the different roles of men and women in forest activities, exploring how policies have influenced their participation. It further uses the concepts provided by gender analysis and SLF to check the potentials for improved participation of men and women in forest management and sustainable rural livelihoods.
Results show that men and women in the research communities are solely dependent on forest resources for their livelihoods. They perform different roles with different interests and needs regarding the forest and its resources. Men and women have different responsibilities in protecting and maintaining homestead, common and forest lands. The results show that men are interested in cash crop production and usually own large plots and a greater proportion of women are involved in food crop production mostly for subsistence.
The analysis of the management practices in both research areas show that formal and traditional ways of managing the forest are practiced. The traditional method is supplementary to the formal as the inability of traditional council to solve some forest problems are forwarded to the court of law where sanctions are taken. Considering that they are few guards to patrol the forest or visit the communities regularly would mean increase illegal activities in the forest. With some recognition, cooperation and mutual understanding between the local people, government and conservation staff, the management of the forest would be improved. The analysis further reveals clashing traditional, governmental and participatory management strategies leading to tensions, conflicts and lack of trust among actors.
Results on gender analysis in research communities portray power relations in forest issues. Rights and access to natural resources like land, trees and animals is gendered. Land tenure rights BFA are hereditary and entitled to the male successor of the family. In KNPA, it is based on demarcation and occupation. However, though land acquisition is open to both men and women in the KNPA, women were found to acquire less land due to numerous responsibilities and lack of strength. The amount of land acquired determines the degree of authority a family or an individual possesses. The analysis also shows that there is some form of change in gender roles although women are not highly represented and even fewer women take part in decision-making processes.
Gender issues are integrated in most policy commitments in Cameroon but if steps are not taken to translate them into practice, the increase participation of women in forest management will remain limited. True change can be achieved if decision-makers ensure an inclusive implementation of gender issues at all levels of project planning. A change in traditional attitudes on the roles of men and women should be adopted and a rethinking on policies (e.g. land tenure and property rights) is necessary to pave the way for greater female participation.
Increased human activity, such as deforestation, is a major driver of biodiversity loss worldwide. In Cameroon, these activities could ultimately threaten the survival of the Nigeria-Cameroon chimpanzee, but knowledge of their abundance and ecology in the Kom - Wum Forest Reserve in Cameroon is still lacking. This research aimed to estimate the population size of this chimpanzee subspecies and assess threats, investigate nesting behaviour, identify suitable habitats, determine feeding habits and document the tools used for food acquisition. Research was conducted using line transects during two seasons: wet (May-September 2018) and dry (November 2019-March 2020). Population size and threats were assessed by georeferencing signs of chimpanzees and human activity along line transects. Nesting behaviour was investigated by recording the characteristics of nesting trees along line transects and mapping their distribution in ArcGIS. Suitable habitat was identified by relating chimpanzee presence signs to local environmental variables related to relief, vegetation and human impact using the Maximum Entropy Species Distribution Model (MaxEnt). Feeding habits were investigated by direct examination of chimpanzee faeces, and tool use was documented by observation and measurement of tools in situ. The reserve is home to up to 83 chimpanzees. Signs of chimpanzee activity were significantly higher in mature forest than in secondary forest, and above 1000 m than below 1000 m. Hunting was the main threat to chimpanzees, and the occurrence of chimpanzee signs decreased significantly with increasing human activity. Chimpanzees preferred tall, mature forest trees at higher elevations with slopes for nesting, and avoided areas near villages and bare land. Only 8% of the study area was suitable chimpanzee habitat. Fruit dominated the chimpanzees' diet, but they also consumed leaves and fruit pith, especially during the dry season. There was also indirect evidence that chimpanzees used tools to consume driver ants (genus Dorylus). Seasonality significantly affected the size of tools used by chimpanzees for driver ant predation. They preferred to use thicker and shorter tools for driver ant predation during the rainy season, whereas longer and thinner tools were used during the dry season. The results of this research highlight the need to reduce poaching and deforestation to protect the remaining chimpanzee population and suitable habitat in the reserve and surrounding unprotected forest. High-elevation and mature forests are critical for chimpanzee conservation and should be a high priority for protection. This research has filled the knowledge gap on what little was known about the abundance and ecology of Nigeria-Cameroon chimpanzees.
Ziel der Arbeit war es, die Perspektiven für Erneuerbare-Energien-Anlagen kleiner Akteure wie Prosumenten unter dem neuen Rechtsrahmen zur Förderung erneuerbarer Energien zu untersuchen und einen Ausblick zu geben, wie die rechtlichen Rahmenbedingungen im deutschen Fördersystem, konkret mit dem EEG, umgesetzt werden können.
Das erste Kapitel befasst sich mit den wichtigsten EU-Rechtsvorschriften im Bereich der erneuerbaren Energien. Massnahmen sowohl auf der Primar- als auch auf der Sekundarstufe waren in diesem Zusammenhang wichtig. Auf der Primärebene, d. Oh Dokumenth. auf der Ebene des EU-Vertrags, spielt der Energieartikel des Artikels 194 AEUV eine zentrale Rolle. Der sekundäre Rechtsrahmen für die Förderung von Energie aus erneuerbaren Quellen besteht im Wesentlichen aus der Richtlinie 2009/28/EG und der Richtlinie zur Förderung von Energie aus erneuerbaren Quellen, die am 21. Dezember 2018 in Kraft getreten sind. In diesem Kapitel erfolgt eine Untersuchung der
Unterschiede zwischen den wichtigsten Richtlinien aus dem Jahr 2009 und der Neufassung der Richtlinie aus dem Jahr 2018. Dazu gehörten insb. die Bereiche Eigenversorgung und erneuerbare Energiegemeinschaften. Im weiteren Verlauf der Arbeiten wurden die europäischen Vorgaben zur Eigenversorgung von Strom aus erneuerbaren Energien sowie die Bestimmungen für Erneuerbare-Energien-Gemeinden mit den deutschen Vorgaben des Erneuerbare-Energien-Gesetzes in der Fassung 2021 verglichen. Der Vergleich zeigte, dass die deutschen Anforderungen weitgehend den europäischen entsprechen, dass es aber noch einige Unterschiede gibt, die vom deutschen Gesetzgeber noch umgesetzt werden müssen, damit die kleinen Akteure das vom europäischen Gesetzgeber eingeräumte Potenzial voll ausschöpfen können.
Zusätzlich zu diesen Kernpunkten wurden folgende Fragen angesprochen. Wie sollte Energie aus erneuerbaren Quellen gefördert werden? Wird die Einspeisungspriorität weiterhin bestehen, und wenn ja, unter welchen Bedingungen? Wie werden Erneuerbare-Energien-Anlagen zukünftig im Engpassmanagement behandelt und wie werden die Verwaltungsverfahren für die Genehmigung von Erneuerbare-Energien-Projekten gestaltet? Auch diese Fragestellungen wurden durch einen Vergleich mit den aktuellen Anforderungen des Erneuerbare-Energien-Gesetzes vertieft und kamen zu dem Ergebnis, dass die deutschen Anforderungen des Erneuerbare-Energien-Gesetzes den europäischen Anforderungen entsprechen.
Die Arbeit endete mit einer Exkursion. Der rechtliche Hintergrund des EU-weit verbindlichen Ziels für den Anteil erneuerbarer Energien am Bruttoendenergieverbrauch von 32 Umschalttaste % bis 2030 wurde näher untersucht.
